'BOSTON Jan 17 (IP)--Babe Ruth
Collapsed tat the bier of his estranged
wife early today
The Yankee slugger made his way
ithrough a crowd of 5000 gathered
around the home of Mrs Ruth's rel
atives and went inside where prepar-
ations for a simple funeral today
were being made
"There's the Babe" shouted the
crowd that jammed the streets for
several blocks
Ruth was acconvanied by Michael
Crowley superintendent of police
and several other Der CMS
Mrs Ruth was burned to death
last Friday night in the home of
Dr Edward H Kinder Watertown
dentist
No Foul Play
Report 'of a second autopsy per-
formed upon ' Mrs Ruth's body re-
vealed last night that suspicions of
her relatives that she had met with
foul play were unfounded The au-
topsy said death was caused by suf-
foeatien and incineration
Ruth a strangely solemn figure in
Ilackwas admitted by Thomas Wood-
ford a brother ef the dead woman
The parlor where l‘Irs Ruth's body
lay in a $10000 casket provided by
Babe was to the left of the hallway
into which Ruth had stepped

At length he rose slowly and fixed
his eyes on the face in the casket

to star at the dead woman His

sobbed
"Oh—oh—oh----oh Helen" he moan-

From a pocket of his great coat
he took a string of tosary beads and
he fumbled these with his fingers af
he knelt at the bier
Finally he seemed obsessed with a
desire to leave the room lie tried
to rise but slipped back int!) a kneel-
ing posture Again he attempted to
regain his feet but fell back mclan-
ing helplessly
Superintendent Crowley and his
son Arthur a close friend of Ruth's
stepped forward and grasped the ball
player's arms
"Come Babe" said ithur
Somebody handed Ruth a handker-
chief and he wiped teate from his
eyes
To Weak to Walk
Even when he had been assisted
to his feet The "Babe" ordinarily a
man of giant strength was too WOIK
to walk He was virtually carried
from the parlor by his friends

"What kind of federal court busi-
ness did he have in these towns?"
Box asked
The contract under which Fitzpat-
rick was employed provided that the
attorney should represent the state
in federal court matters
The question did not receive a re-
ply The banking department's employ-
es said there was about $1800 left
in the fund out of which Fitzpatrick was paid but that $144110 was
part of a trust fund which could be
used only for filing cases and other
court expenses

threatening his impeachment Oklahoma's governor finds time to
consult the stars and seek what effect cosmic contemporaries
have en the public mind
This was revealed today by L Howell Lewis Oklahoma
City astronomer -who forecasts earthquakes foretIls world
and cosmic disasters and counsels with Governor Henry S
Johnston
While Satellites of the house of representatives and the
spiral nebulae of the senate delve deeper in search of alleged
high crimes againat the state the governor is examining Lewis'
charts of the skies Lewis divulged
Lewis a grey and bent man of SO years and for 60 years a
student of the stars said Johqston was interested in the science
of astrophysics—that study which reveals the effect of sun
energy on the mental make-up of the human masses
' Keeps Out of Fuss
When discovered in capitol corridors conferring with the
governor on charts showing effects of radio-electric-magnetism
of the sun on a turbulent world and turbalent people Lewis
was questioned if he had advised the governor on political
futures

son is a member of the banking bawd

nttacic Dawson said he knew noth-
ing about the legality of the certi-
ficates nor of the circumstances un-
der which they were issued He
bought them because he was request-
ed to do so by Mothersead chairmon
of the banking board he seid
Kight On Stolid
Tom Kight one of the four horse-
men of the last legislature took the
stand for a few minutes at the after-
noon session Kight said that he was
chairman of the appromiation com-
mittee of the last legislature A bill
Providing a $12500 appropriation for
the banking department was before
his committee It was out of this
fund that Kirby Fitzpatrick late: was
Paid as special attorney for the bank-
ing department
Kight said ha was given definite
assurance by Mothersead and Gover-
nor Johnston that the appropriation
would not be used to employ an ad-
ditional attorney
Assured by Governor
He said Mothersead voluntarily
brought Governor Johnston into the
committee room and the governor
said:
"I understand you are inclined to
oppose this bill because you think it
may be used to hire another attorney
I came in here to give you absolute
assurance that not one penny will be
used to employ an evtra attorney"
Resolutione Rejected
Several resolutions were introduc-
ed before the iappropriation commit-
tee and before the house asking feor
the employment of an attorney for
the banking department Kight said
They were all rejected
Referring to the deficiency war-
tents issued by the governor Kight
said:
"The governor knew that the leg-
islatnre had refused to employ an
extra attorney for the banking de-
partment when he issued these defi-
ciency certificates
"If the legislature fails to make
an appropriation for an office then
the effice dies The governor wculd
have no tight to recreate an office
and provide money therefor by means
of deficiency certificate'
"If the givernor couil create those
offices in the state banking depart-
ment and issue deficiency certificates
he can just as reasonably mate a
hundred new offices in the capitol
and issue certificates to pay their
expenses" Kight said
Eldridge Unfound
Efforts of the committee to sum-
mon J W (Buck) Eldredge before
it failed Thursday Eldredge was
discharged Tuesday from the state
bureau of criminal investigotion
Much of the testimony in the past
two days has centered about his poli-
tical aetivities while working as at
under-ccver investigator for the
state
The committee adjourned at I:20
to meet again when the afternoon
legislative session is over

IN THE CITY OF CUSHING OK-
LAHOMA AGAINST THE SEVER-
AL LOTS PIECES AND PARCELS
OF LAND BENEFITED BY SUCH
IMPROVEMENT
BE IT ORDAINED BY THE MAY-
OR AND COUNCILMEN OF THE
CITY OF CUSHING OKLAHOMA:
SECTION 1 That Whereas the
Board of Appraisers heretofore ap-
pointed by resolution to appraise and
apportion the benefits resulting from
the paving and otherwise improving
of the portions of streets and public
places described in the title of this
ordinance to the several lots pieces
and parcels of land which are liable
to assessment to pay the cost of such
Improvements which cost has been
ascertained to be the sum of $11369-
SI has performed its duty according
to law and has returned and filed
with the City Clerk a written report
of its appraisernent and apportion-
ment and
WHEREAS after the filing of said
report the Mayor and Councilmen did
appoint a time for holding a session
to hear and eonsider any complaints
or obJections concerning such ap
Ipraisement and apportionment and
caused due notice of such session to
be published according to law and in
Ipursuance of such action and publi-
cation such session was duly conven-
ed and held by the Mayor and Coun-
cil on the 20th day of December
1928 and
-
WHEREAS at such session the
Mayor and Council did hear and con-
sider all complaints and objections
to said appraisement and apportion-
ment and did then and there review
the same and did by resolution con-
firm said appraisernent and appor-
tionment as so reviewed and
WHEREAS all legal requirements
have been full ti complied with to au-
thorize the levying of assessments to
pay the cost el said improvements
against the several lots pieces and
parcels of land benefited thereby and
liable to such assessment:
NOW THEREFORE there shall be
and hereby is levied and assessed
against the several lots pieces and
parcels of land benefited the amounts
respectively stated in said report of
the Board of Appraisers and re-
viewed and confirmed as follows:

Lewis explained the 'theory of radio-electric magnetism which
had interested Johnston
We have what we call ah over-plus of radio-electric-magnetism
in the world today his force has a direct effect upon
the human nervous system
85 Per Cent Insane
"As a result of this over-supply the world is fast going to
madness Do you know that 85 per eent of the people of this
country are insane?" -P
He commented that these astro-physical phenomena could
cause almost every form of motign absurdities "from short
skirts of the women to foaming-at-the-mouth legislators"
Unless these cosmic forces which to the lay mind are in-
comprehensible are arrested by an unexpected development in
the universe Lweis forecasts the greatest disasters of all time

Asked what his analysis of the governor was Lewis said
"The Governor has the greatest evilibrium of any man I have
known Ho treads a straight path Primps he has made a few
mistakes but when you consider he is dealing with thousands
of people and that 85 per cent of them are affected by radio-
electric-magnetism this is not unusual

Lewis said that Oklahoma its 'automobilism" itS crime
and its turbulent politics was typical of a new state---the effect

SECTION 2 That the aaaessments
hereby levied against said several
lots pieces and parcels of land shall
bear interest from the date of the
passage of this ordinance at the rate
of seven (7) per cent per annum'
and said assessments shall be payable
in ten equal annual installments The
first of such installments with inter-
est to that date on the whole assess-
ment shall be payable on or before
the first day of September 1929 and
one installment thereof with interest
on the whole amount remaining un-
paid to said dates respectively shall
be ravable on or before the filet day
of September of each of the years
1929 to 1038 inclusive Provided how-
ever that the owners of the property
so assessed shall have the privilege
of paying the amounts of their re-
spective assessments without inter-
est withing thirty (30) days from
the date of the publication of this
ordinance 1
SECTION 3 That this ordinance
shall take effect and be iii full force
from and after its passage and pub-
lication according to law
