CIGARETTE PAPER TROUBLE
American Tobacco Officials May be
Brought to Trial
GUTHRIE: Oklahoma officials be
lieve they have found a method by
which they can handle the officers of
the American Tobacco company for
selling cigarette papers through the
mails to citizens of the territory thus
attempting to defeat the stringent
anti-cigarette law in force here Only
the refusal of Governor Iliggins of
New York to honor requimitions is-
sued by Governor Fergunn to bring
officers of the American Tobacco com-
pany to Oklahoma for t:Ial can de-
feat this method according te a state
ment made by a well known attorney
This attorney quoted three sections
from Oklahoma statutes to Vek up
his statement as follows:
Sec 1930 Wilson's Oklahoma stat-
utes: "All persons are liable to pun
ishment under the laws of the tern!
tory who commit in whole or in part
any crime in the territory" Section
1947 same statutes: "All persons
concurring in the commission of a
crime whether they directly commit
the act constituting the offense- or aid
In its commission though not pres
cut are principals" Section 2150
same statutes: "If two or more per-
eons conspire to commit any crime
and then some act is done to effect
the object of the conspiracy by one
or more parties of the conspiracy
each is guilty"
The attorney referred to above said:
"It is an established principal of aim-
Inal law that if a person is outside
the limits of a state or a territory he
may yet commit a crime against an-
other state or territory if he can com-
mit the Injury by an innocent or
Ignorant agent having no will in the
matter For instance man may stand
In one state apd shoot a bullet across
the line and kill a person in another
state and would be gulty of murder
in the other state although never set-
ting foot in it also if he stands
across the line and directs some child
too young to know better to carry
fire across the line and set fire to
buildings he is guilty of arson in the
other state although he was never
within its limits Lawyers have many
other illustrations of this principal
"When therefore the cigarette peo-
- pie send by the postoffice department
of the United StatE s a proposal into
the state to sell cigarette paper to
a citizen of the state they thereby
make the postoffice department their
agent to carry that offer and when it
Is accepted by a person in Oklahoma
Indiana Nebraska or any other state
by mail the postoffice department In
Jaw is considered the agent of the
cigarette people and as their agent
receives in Oklahoma the acceptance
and when the cigarette people in re-
sponse to that acceptance send by
mail that cigarette paper they de-
liver It in Oklahoma and the com-
pleted transaaion is an Oklahoma
transaction and that transaction
where the paper Is brought to be
used by the purchaser Is not protect-
ed by the interstate commerce law
or by any other United States stat-
ute" Governor Ferguson will be asked to
adopt this method against officers of
the American Tobacco company
which has been flooding Oklahoma
with packages of cigarette paper dur-
ing the past two weeks
