LANCASTER, Pa. (AP) - A man who claimed
his wife used a CB radio to attract lovers has been
convicted of voluntary manslaughter for killing
her with a shotgun while she slept.
A Lancaster County Court jury of six men and
six women deliberated 55 minutes Thursday be-
fore returning the verdict against James W.
Shimp, 41.
The maximum penalty is 10 years in prison and
a $25,000 fine. He will be sentenced later.
The former fire chief in nearby Adamstown had
been charged with first-degree murder in the slay-
ing of his wife, Frances, 41.
Shimp testified that he acted out of frustration
and anger after he found his wife at a diner and
she refused to leave with him.
While on his way home he heard her calling on

Leg removed;
struggle over
County Probate Court
order giving Mrs Lane
temporary custody
over her mother.
The woman s sons op-
posed Mrs. Lane s law-
suit, saying they want-
ed the decision to be
made by their mother.
Doctors said the gan-
grenous leg would have
killed Mrs. Candura in
three weeks if it had
not been not removed.
Another son, Charles
Candura, Braintree,
said his mother was de-
spondent because of
the death two years ago
of her husband of 53
years and because of
two previous amputa-
tions of a toe and part
of her foot due to gan-
grene.

Jurors ignore CB story
her CB radiq for "Flying Angel." a name included
on a list of lovers that she had contacted over her
radio. Shimp testified.
He said he recognized his wife's voice and her
CB nickname. "Brown Eyes." He shot her about 1
a.m. the next morning after she had returned
home and fallen asleep in her bed.
Shimp's attorney told the jury that Mrs. Shimp,
mother of four children ranging from 7 to 15 years
of age, had carried on adulterous affairs for two
years using the radio to make contact with her
lovers.
Much of the testimony was supported by police
officers, firemen and friends.
"She treated Dad like trash," his eldest daugh-
ter, Bonnie, testified.

ARLINGTON. Mass
(AP) — Rosaria Candu-
ra has changed her
mind and allowed her
gangrenous leg to be
amputated.
The operation Thurs-
day ended a family
struggle caused by the
77-year-old widow s
previous refusal to un-
dergo the life-prolong-
ing surgery.
Officials at Symmes
Hospital said Mrs. Can-
dura was in good condi-
tion after the amputa-
tion.
Mrs. Candura's deci-
sion to agree to the sur-
gery followed a lengthy
Wednesday night dis-
cussion in her native
Italian with her
brother, Salvatore
Napoli, 62, of Fitch-
burg.
Napoli came to the
hospital at the urging
of one of Mrs. Candu-
ra's three sons.
"We don't know what
he said, but he prom-
ised to visit her often
after the operation,"
said Vincent Candura,
Jr., one of the sons.
Earlier this week, the
state Court of Appeals
rejected a plea by Mrs.
Candura's daughter,
Grace Lane of Medford,
that she be made a le-
gal guardian in order
to authorize the opera-
tion.
The ruling declared
Mrs. Candura "has not
been shown to be legal-
ly incompetent," and
reversed a Middlesex
