paper, under the btad of "A Rich
Find," vou published an article tn ref
erence to the taxation of the costs In
the case of the Territory vs. Mr*
Cartwright, which creates a fahelrn-
ptesslon in this, that It is made to ap
pear that a bill of the clerk's personal
fees was found to be exhorbitant, In
correct and Improper. This is not
true, as will be explained later In this
statement.
As to Mr. Davis assisting lu the
taxation of the costs, 1 desire to say
that Mr. Davis had nothlug whatever
to do with ttx ng these costs, he
merely appearing with a note fn m
the county clerk, whch note asked,on
behalf of the countv commissioners,
that a statement of the -ts In the
case be furnished the board of couuty
commissioners, which ststemeut was
prepared by Mr. Neal and by him
given to Mr. Davis.
The costs taxed in the judgment in
this case were taxed by Mr. Lyman
Allen, atH Included the cost of all the
officers of the court for two days, to-
gether with t he costs of the entire
panel of Jurors In attendance during
the trial or the case.
Tue difference in the two state-
ments Is caused by Mr Neal not tak-
ing the costs of the entire Jury panel
for two days, and for the attendance
of b&lllit, for grand jury, etc.
Where the judgment reads for all
costs it is a question, the Btatute be-
ing silent as to what constitutes the
costs in a case. The County Attor-
ney, Mr. Brown, advised me that the
costs of the jury are no part of the
costs of the case. These are ques-
tions of law which the county com-
missioners and the county attorney
should determine in the adjustment
of Mrs. Cartwright's costs. It is a
matter that effects them, not me
My costB in the case were tl4.2K, as
shown by the appearance docket, and
the statement furnished the county
commissioners in no way affect or
change my costs in the case, hence
the insinuation that I had in some
way attempted to collect improper
fees was not true.
1 will be pleased at any time to
enter into an explanation, such as I
cannot do in this statement, if called
upon to do so by any one at the clerk's
otiice. Very truly,
