Federal Indictment for Introducing

ery criminal case transferred from

tory to tho stato courts. I
Th eattorneys of Warner today
applied to Judgo L. M. Poo to have
quashed tho Indictment against him
but Judge Poo refused to enter Into
tho merits of tho caso and on tho
question of tho wording of tho In-
dlctment which was tho only point
on whloh ho would take Jurisdiction
at this time held that the instru-
ment was correct nnd denied UiO

ed tho Indictment It Is the genera!;
belief that every Indian Territory
federal prisoner would have been
freed.
There Is a question In the minds
nf many attorneys whether n county
court can take r.ny Jurisdiction In
any easo transferred from tho fed-
oral dockets. Tho United Stlfs
supreme court has ;.rld that no
count fnurt can command n United
Stato marshal. In all probability
th.i United States supreme court will
be called upon to .ct thins right
e-foro the United States pt'onrr

Several thousand criminal cases
wero transferred from tho "federal
dockets In Indian Territory to tho
state courts.

A dilemma that now confronts nil

this was dono by tho federal courts.
Now thero aro no federal courts with

McAlester Operators Say Rates Will
Not Cause a Scarcity.
Guthrie Okla. Nov. 27. Thero ap
pears to bo no danger of a coal
famlno in Oklahoma by reason of
tho corporation commission's pro-
posed application of tho Arkansas
coal rates on Oklahoma rail lines.
It has been stated that coal-carrying
roads would forco shipment:; through
to other states rather than submit to
a scaling of tho tariffs necessarily
reducing tho supply available for
V.oz.o consumption. Only two largo
roads operate mines. Olio of those
markets 110 commercial coal while
the other lo nnd two udltlonal do
a limited commercial business be
sides marketing their own coal.

Tho McAlester coal operators ac-
cording to a representntlvo who mas
hero today would appreciate 11 re-
duction In tho coal rates ns every-
thing Is hold f. o. b. tho mines. Under
this arrangement It Is shown tho
transportation companies do not con-
trol tho shipment or sale.
"Tln only sale where wo have to
deliver tho coal" ho said "Is on
government contract nnd If tho
producer falls In tho delivery ns to

It Is understood that tho Okla-
homa mine nro able to market
their output with little difficulty
and according to tho Informant
would normally prefer n homo mar-
ket to onu In another state pro-
viding they nro In position to se
cure cars and transportation. It has
been Intimated that this feature of
tho coal business will bo brought
before thu commission probably by
dealers at an early date. Tho com-
mission has stated that tho recip-
