17 Federal Liquor Licenses
In Chickasha
Guthrie Okla. Dec. IS. As an indi-
cation of the extent of the violations
ui the prohibitory law in Oklahoma
State Enforcement Attorney Fred S.
Caldwell has investigated the records
of the Internal revenue collector at
Leavenworth Kan. and found that
there are 70S persons and companies
In Oklahoma holding federal liquor li-
cense. Vnder the enabling act. the
constitution and the Billups enforce-
ment act the possession of such li-
cense is prima facie evidence of vio-
lation nf the law and the holder of
every such license Is subject to prose-
cution by the state authorities.
Mr. Caldwell is having printed for
jjistribution over the state among the
i jtiHi'KSIs awl county attorney's a pam-
phlet giving the names of the holders
of 'federal licenses in each town and
qttotlng the provisions of the consti-
tution and statutes on that subject.
He also informs the county attorneys
that by paying $1 to the internal reve-
nue collector they can secure official
iists of the persons holding liquor
liquor licenses In their respective
counties.
According to Mr. Caldwell's list
Oklahoma City leads in the number
of violators of the prohibitory law
having 150 federal licenses. Other
towns holding such licenses and the
number In each are as follows:
Muskogee 31; Ardmore 8; Afton
2; Bartlesville 27; Coalgate 20;
Chickasha 17; Clareniore 7; Coweta
6; Chelsea. 6; Eufaula 13; Enid 9;
Guynion 2; Guthrie 2; Kiefer 17;
Lehigh 10; Lawton 3; McAlester 15;
Mlan.l 19; Shawnee 48; Sapulpa 19;
Tulsa 38.
Mr. Caldwell has arranged with the
internal revenue collector to receive
bi-monthly reports on licenses Issued
thus keeping him continually in pos-
session of a revised list. Upon the In-
formation which he furnishes the lo-
cal officers can cause the arrest of
all persons whose names appear on
the list and secure search warrants
to search the places for liquor. The
enforcement attorney also stated that
the local officers could secure injunc-
tions against keepers of joints as was
done In Kansas and lock up their
places. The Oklahoma constitution
however allows a trial by jury in In-
junction cases which cripples the ef-
fectiveness of that proceeding.

Would Pay Money to
Sac and Fox Indians
Special to The Express.
Washington Dec. 18. The secre-
tary of Interior has sent a communi-
cation to congress In which he asks
authority to py $100000 to Sac and Fox
Fox Indians. This amount is known
as "The Sac and Fox of the Missis-
sippi In Oklahoma fund." He also
asks authority to pay to them $12164
of what Is known as "The Grass
Money."
The Indians through their council
have made a request of the payment
of this money to them on the grounds
that the Interest arising from It when
paid to the Individual is not sufficient
to Justify them In the expense of hav-
ing a payment made. This will wipe
out both funds In full and the In-
dians claim to want the money to Im-
prove their lands.

Washington Dec. 18. Senator
Owen has two appointments to make
at the naval .academy at Annapolis for
which there are no applicants. One
Is the principal for a cadetshlp which
carries with it all the privileges of
the regular training course of four
years. The other Is the appointment
of a second lieutenant in the Marine
corps at a salary of $1700 per year.
He is looking for some Oklahoma man
who can pass the stiff examination
required to fill this appointment.

of W. W. Robertson of Oklahoma City j

took the examination at that time.

Washington Dec. 18. There Is di-
versity of opinion in the Oklahoma
congressional delegation as to wheth-
er the state legislature has the .au-
thority to move from Guthrie the
state capital until 1913 the time
fixed In the enabling act.
Senator Owen Is of the opinion that
the legislature has the authority. He j
cites the clause in the enabling act
which requires that the capital re-
main at Guthrli until 1913 and then j
turns to another page of the enabling!
aci which says that Oklahoma shall
be admitted with .9 II the rights of
oiher states. Other states have the
right through their legislatures to!
move a capital If they so desire.
Senator Gore would not exprpss an
opinion. To a query he facetiously
replied "I am not In a position to
Judge the matter just now. I am
going down to Guthrie the first of
3h year and perhaps I may find out
then." Senator Gore Is going to Okla-
homa to be present the second Tues-
day in January at which time the leg-
islature will re-elect him to the sen-
ate. Congressman Bird .tcGuire In
whose district Guthriri Is located Is
emphatically of the opinion that the
legislature has no authority to move
the capital prior to J913. Ho says
that the enabling act and the consti-
tution provide for this and In addi-
tion to Its being part of the consti-
tution. It Is an agreement with the
government that Is irrevocable even
by a vote of the people. He Is ot
the opinion that if any attempt is
made to move the capital from Guth-
rie It will be met by Injunctions from
the federal court.
Congressman Fulton In who dis-
trict lie Oklahoma City and Shawnee
both candidates for the capital says
that this Is purely a question of law
and one that has not studied suffi-
ciently to pass an opinion on. He U
investigating the matter now.
Congressman Carter In a general
way Is of the same opinion that Mr.
Fulton holds. He thinks It a matter
of law over which there need be no
contest when It Is Investigated thor-
oughly. Congressman Scott Ferris
and Davenport are not satisfied what
the law Is. Mr. Davenport Is rather
Inclined to the belief that consider-
ing the vote of the people at the last
election when they decided to locate
the capital on a new townslte might
be sufficient justification for the leg.
