Punishment at Life Imprisonment Re-
turned in D. O. McNeil Case.

Room Thronged.
The trial of David Orr McNeil for the murder of Anson D.
Green was completed in the District Court Judge W. C. Crow
presiding Tuesday night about 10 o'clock with the close of rtrgu-
mont before the jury. The twelve men who were to determine
the Fate of the defendant immediately retired to the jury room
in charge of the bailiff and taking with them the instructions of the
Court. Shortly after the noon hour the next day (Wednesday)
they announced that they had reached a verdict. In the presence
of the Court the defendant and counsel for the State and defense
the foreman of the jury announced that he defendant David Orr
McNeil had been found GUILTY of murder in the first degree
and a sentence of life imprisonment in the state penitentiary
imposed.

shot his victim in self defense that he
lived for years in danger of being mob-

"I'll kill you ; I'll mob you" and made

The testimony of the experts was to
' the effect that McNeil because of his
1 paranoia condition actually heard and
saw what he said he heard and saw
although in reality such things never
happened.
The prosecution attempted to show
by the eye-witnesBes to the murder
and by acquaintances and neighbors
uho had known the defendant for
years that lie was sane always had
been sane through eccentrlo and was
sane at tl.e time the murder was com-
mitted ; that the deed wasconsummat-
' eJ in cold-blooded premeditation and
to satisfy a personal hatred and avenge
a real or fancied wrong. The deceased
'and the defendant lited for a number
of years on adjoining farms and dur-
ing that time controversies frequently

after trial. It was not disputed that
an enmity of many years standing had
existed between the two men and thh
State contended that the atrocious
crime was committed as a result of
this feud.
It was shown by the Stato and not
disputed by the defense that on Oc-
tober 1'Oth 101(1. nhortly after the noon

west on mo sidewalk McNeil wbs i
walking east on the sidewalk; Jim
Morrison was sitting on his delivery
wagon and Harry Gray was standing
at tho end of tho wagon about four
feet from where the victim fell ; Hev.
Wheat aim wife were biltinu in their
car in the street near tint scene. All
went eye-witnesses to the shoot'ng
McNeil und Green met neither spoke
they passed and each proceded a few
steps in the directions in which they
were going when McNeil whirled about
and whipped a revolver out of a scab-
bird under Ills 1 ftnrm firing a i-liot
into Green's bnuk. The shot pene-
trated the victim's heart. Green's
b.idy swerved when struck turning to-
ward h'is assailant. Another shot was
fired Into his cliesr. as ho fell. This
shot too penetrated the heart. The
murdered man fell to tho walk might-
ing on his right arm and shoulder his
left leg slightly extended upward as
he writhed in the throes of death.
While in this position the third shot
was fired into the unfortunate man by
his assailant. This shot penetrated the
lower limb passed out through the
thigh and entered the abdomen Mc-
Neil then stepped to the recess of the
doorway placed another cartridge in
his gun und remained for a few mom-1
outs. He then stepped Inside th
Truax Hardware store removed the
empty shells and re-loaded his revol-
ver. Returning to tho sidewalk ho
Btood for a moment leaning against
the building. About that time Deputy
Sheriff Frank Shockley drove into
Forgan and to tho scene of the shoot-
ing. McNeil was taken into custody
and subsequently taken to Woodw rd
where he was confined in the county
jail of that county. A fow weeks ago
lie was brought to Heaver and lodged
in the county Jail
The caso has attracted wide spread
Interest and the trial was attended by
a crowd which lllltd the Court room
to its full capacity during the entire
live days and nights. During the clos-
ing hours of testimony and the argu-
ment of tho case the 'court room and
halls and office rooms leading to it
wore pscked and standing renin was at
a premium. Such a crowd was never
assembled before in the history of the
Courts of Beaver county. Notwith-
standing the great assemblage the
best of order prevailed and the crowds
were quiet and attentive. The battle
