general of the interior department
as to the authority of the .govern
ment to send troops into the Chick
asaw nation for the purpose of en-
forcing the collection of tribal
taxes ou merchants doing business
in that country.
Secretary Hitchcock is inclined
to look upon tie proposition witn
disfavor though Special Agent
George D. Wright insists that fed
eral troops alone can restore order
and f stablish the supremacy of the
law in relation to the collection of
taxes as the judicial authorities
are helpless to meet the require
ments of the situation-
The request of Gov. Johnston
of the Chickasaw nation was form-
ally presented to the secretary of
the interior last Friday afternoon
by Special Agent Wright and Com-
missioner of Indian Affairs Jones.
For more than an hour these three
officials discussed the situation in
all its details Mr. Wright? sup-
porting the request of Gov. John
ston in a Btrong argument which
met' the approval of the commis-
sionpr of Indian affairs but did
not seem to be falling upon as fer
tile soil with the secretary who in-
quired particularly for details. In
explaining the necessity of such
action Mr. Wright said that under
the provisions of the Chickasaw
treaty approved by congress in
1898 the ChickEsaw tribal form of
government was to be perpetuated
for the period of eight years after
which time it is to become extinct
and the people of.the nation are to
become citizens of the United
States. Under the provisions of
that treaty the Chickasaw council
.was given authority to eract legis
lation for the government of the
people and the raising of revenues.
The couneil among other things
enacted a law-imposing a tax on
all neoole not "members of the
tribe doing business in the nation.
This fell particularly "heavy upon
the merchants who have resisted
Davment. and many of whom are
now openly defying the law. The
tribal statute provides that in the
event of failure to pay the tax the
offender shall be ejected from the
nation and a second conviction is
made a misdemeanor liecently
the merchants have bauded to
gether and formed a society wich
Sier Simon as president for the
purpose of resisting the enforce-
ment of the law. Offenders have
recently been arrested and deported
under guard but have returned
immediately. When re-arrested
juries composed entirely of white
people have been empaneled who
have promptly acquitted the ac-
cused thus rendering the law vir-
tually a nullity. In the meantime
the Indians are growing restive
and insist that it is the duty of the
government to see that their laws
enacted under authority from the
federal congress are respected and
enforced.
After reviewing the situation
Secretary Hitchcock was disinclin-
ed to call on the secretary of war
for troops. His objections were
first that he preferred to exhaust
every possible resource in the
courts before taking this extreme
step which would surely result in
increasing the feeling bet ween the
traders and the Indians to a very
pronounced extent and second
because he was not sure be was
clothed with the authority.
Special Agent Wright insisted
that every other possible means
had been exhausted and that this
was the only remedy left which
could prove efficacious. He said
the officials in the territory were
now encountering the greatest dif-
ficulties in the enforcement of the
laws and that unless the depart-
ment adopted prompt measures in
this and otherycases arising the
difficulties would be increased
many fold. ; In short he insisted!
that the department must either
enforce the laws in the Chickasaw
nation with military assistance or
abesdon them. .
: Commissioner Jones raised th
department in honoring a reauest
preferred by a governor of an In-
dian nation for federal . troops.. ' It
was finally decided to refer this
question to the attorney general for
a judicial opinion though the sec
retary was inclined to the belief
that even if the government here
could not act upon a request pre
ferred by a governor pf an Indian
tribe a request from a government
official occupying the relations to
the territory that does Mr. Wright
would be a proper one for the gov-
ernment to act upon.
While no definite decision was
reached it is believed that if the
attorney general finds no legal ob-
stacles in the "way a call will be
made on the secretary ' o. war for
troops and. a determined -effort
made to enforce the laws and sup-
press all violations of them in such
that there . will be
