ion rendered Tuesday morning Judge
John H Cotteral holds that only home
steads of Osage Indians which consist
of ISO acres are exempt from taxation
by the county and state authorities
The Question was brought up In the
suit of -the commissioners of Osage
county to collect taxes on all lands
owned by the Osage Indians' j
Judge Cotterai's Interpretation of
the-Oaage alloting- bill whch was ap-
proved In June 1906 Is to the effect
that after three years all lands owned
by the Indians with the exception of
their -homesteads are taxable
As this law became effective In 1909
taxes of 1911 are Involved The decis-
ion means that over a million acres
of land wU be taxed In Osage county
which heretofore has been of no bene
fit to the coffers of the county
-The contention of attorneys for the
land of the Osages waa taxable Judge
Cotteral however interprets the law
to mean that the homestead of every
Indian la absolutely exempt

The Frisco passenger train due here
at 8:80 p m did not arrive yester-
day afternoon until 6 p m being de-
layed by the derailment of a wrecking
train two miles east of Morris Only
one car the one carrying the lifting
crane was derailed An hour and a
half wae required to get the car back
on the rails hand Jacks being used
for the purpose No one was hurt
Chief of Police Dick Farr is clrculat

ositions were before the meeting
