IICSBAND AND WIFE
In the relationahip of huaband and
wife there are certain indMdual
and certain mutual rights Neither
the husband nor the wife as such
is answerable for the acts of the
other The earnings of the wife are
rot liable for the debts of the hus-
band and the earnings and accumu-
lations of the wife and her minor
children living with her or In her
custody while she Is living separate
from her husband are her separate
property
The Individual property of the
husband is not liable for the debts
of the wife contracted before her
marriage The individual property
of the wife is not liable for the
debts of her hueband but ft fs liable
for her own debts contracted both
before and after marriage
If a husband reglects to make
adequate provision for his wife any
other person may in good faith
supply her with articles necessary
for her support and recover the
reasonable value of them from the
huaband This provision does not
apply when the wife has abandoned
her husband until she offers to re-
turn unless she was justified by his
misconduct in abandoning him
Neither is he liable for her support
when she is living separate from
him by agreement unless such sup-
port is specified in the agreement

any contrnct with each other alter
their legal relations except as to

natural right she ha l the same right
to appeal in her own name to the
courts for redress and protection as
has her husband
The declaration of the law how-
ever is that the husband is the
head of the family He may choose
any reasonable places or mode of
living for his wife and children
When the marriage relation is en
tered Into the husband and wife
contract towards each other obli-
gations of mutual respect fidelity
and support
The husband must support himself
and his wife out of his property
or by his labor The wife must
support the husband if he has not
deserted her out of her Individual
property when he hes not individual
property and is unable by Infirmity
to support himself
After marriage either the hus-
band or wife may enter into any
property transactions with others
which they might have transacted
if unmarried
A wife may without the consent
of her husband sell her individual
property
Legal Action
No husband nor wife shall in any
criminal case be a witness against
the other except in a prosecution
for a crime committed by one
against the other but they may in
all criminal enses be witnesses for
each other and shall in no event on
a criminal trial be permitted to dis-
close communications made by one
to the other except in a crime com-
mitted by one against the other 1

The father of a legitimate un-
married child is entitled to its eggs-

legitimate by the subsequent mar-
riage of its parents
A married man not lawfully sep-
arated from his wife cannot adopt
a child without the consent of his
wife nor can a married woman not
thus separated from her husband do
