John and Mary Smith decide
to add a den on to their house
John looks in the telephone
book finds the name of a con-
tractor and calls him After a
discussion of the type of den
needed the contractor makes
some sketches on the back of an
old envelope and states that he
will dodhe Jon for $275000 com-
plete Joe the contractor seems
like a nice fellow so John and
Mary agree
The job took about a month
Mary noticed that there were
lots of other men working
around the house beside Joe
There was an electrician a
plumber to put in the new bath
room fixtures a tile man to put
in the floor a roofer to put on
the new shingles and a painter
After Mary and John moved
In their new den furniture Joe
the contractor called and stated
that the job was completed and
that" he would be happy to have
their check for $275000 The
next morning John mailed Joe
a check marked "paid in full
for den job"
A week and a half later with-
in the space of two days John
and Mary received written no-
tices from the electrician from
the plumber from the tile man
from the roofer and the painter
that they had filed mechanic's
and materialman's liens against
John's house in varying sums
totaling $2000 John immedia-
tely called Joe and Mrs Joe an-
swered the phone and stated she
would like to know where he
was too Joe had left town Joe
of course had cashed John and
Mary's check prior to his de-
parture John quite alarmed consults

OUR NATION'S CAPITOL moved from Philadelphia to banks of the
Potomac in 1800 today is a majestic city nerve center of a great
country1 and the hope of freedom-loving people everywhere The
capitol dome sprawling office buildings monuments memorials
and 7000 acres of public parks including the Mall shown here are
familiar sights to countless Washington visitors
an attorney and discovers that
all of Joe's sub-contractors: the
electrician plumber tile man
roofer and painter now have
the right to foreclose the mech
anic's and materialman's liens
which they filed against John
and Nfary's house because Joe
the contractor had not paid
them John was shocked to dis-
cover that these liens are almost
like a mortgage that he signed
himself against his house
John and Mary's attorney
after a thorough investigation
of the facts and an examination
of the lien and the notices serv-
ed succeeds in compromising
the $2000 worth of lien claims
and getting releases for $1500
John and Mary spent then
$42500o to get a $275000 den
built
What could John and Mary
have done in advance to prevent
paying nearly twice what they
had agreed to pay? Here are
four suggestions:
(1)—Enter into a detailed writ-
' ten contract with the con-
tractor specifying the work
to be done the price to be
received completion date
and see that it is properly
dated and signed
(2)—Get the names of anyone
that does work on the job
and require the contractor
to obtain lien waivers prior
to turning over the contract
price upon completion
(3)—Use care in the selection of
your contractor
(4)—S e e k the assistance of
counsel in drafting the con-
tracts and in closing up the deal
In larger construction jobs
and in industry the problem is
WYNNEWOOD
handled by requiring the con-
tractor to post a bond to the
effect that he will pay all of the
materialmen s u b contractors
laborers etc and if he doesn't
the Bonding Company will This
if required adds expense to the
contractor which he normally
calculates into ft e contract
price and is infrequently used
on smaller jobs
