HUNT IN 1959

' About 60 days and Hugo should
know if Mr and Mrs Eddie Ross
publishers of Mountain Music
plan to accept the local sportsmen's
invitation to return here in 1959 for
another national wild coon hunt
No exact commitment was made
by Rosa before leaving after the
highly successful hunt held here
last week but he did say it would
be in this area and his general at-
titude and that of the hunters en-
courages the idea that it may be
back in Hugo
1 Ross said the local hunt was a
success in many ways and beyond
his anticluations in most It was
71 ' the first hunt of its kind and size
1 held in Oklahoma
1 A total of 134 hounds worked a-
1 ficially in the 34 casts a number
ii other dogs were in the woods
1 unofficially and about an equal
number were entered in the Satin'
' day bench show or were here for
- trading purposes
' There never was a shortage of
coons it was noted and bobcats and
other wild animals furnished addi-
tional sport
Hunters came from 20 states
: ranged in ages from 14 to 73 years
and represented numerous business

GROUNDS FOR NEW TRIAL
Last week's article dealt with
some of the grounds upon which a
new trial may be granted but
there are other and further rea-
sons which will be discussed in
this article
Although Jurors themselves may
not impeach their own verdict oth-
er witnesses may be used to show
that they acted wrongfully in ar-
riving at a verdict—such as taking
an unauthorized trip to the scene
of an accident talking to each
other about the case during the
trial unauthorized talking to at-
torneys in the case or as some-
times happens casting lots in ar-
riving at a figure for damages ie
a quotient verdict
Moreover if their verdict is not
supported by sufficient evidence
or appears to have been excessive
and given under the influence of
passion or prejudice it may be set
aside and a new trial granted If
damages are inadequate in any but
an action for personal injuries or
excessive that may be a ground for
a new trial
If the damages are excessive the
court may as an alternative advise
the winning party that if he will
not give up a part of his verdict
a new trial will be granted so that
forcing the winner to make the
decision on the motion for himself
New trials will also be granted
In certain circumstances where
neither the court opponents nor
the Jury have erred
Where accident or surprise which
was not foreseen prevented the
loser from having a fair trial or
where through the death of the
court reporter or through loss of

for the granting of a new trial The
