You are hereby notified that
he City of Coalgate Central
District Indian Territory by its
proper officer or officers acting
in accordance with the provisions
of the Act of Congress of June
23th 1893 entitled “An Act for
the Protection of the People of
the Indian Territory and Other
Purposes” putting into force and
effect in the Indian Territory
sections 907 to 912 inclusive of
Mansfield’s Digest of the Stat-
utes of Arkansas will upon the
9th day of April a d 1907 or
so soon thereafter as" it may be

In the matter of the app’ica-
tioa of the City of Coalgate an
incorporated City of the sec nd
class for a jury to inquire into
and a-sess all damages or com-
pensation for all lands and im-
provements thereon to be enter-
ed upon taken condemned and
appropriated by said City for the
purposes of watershed reservoir
and dam pumping station and
tower for a system of water-
works for the said City

Comes now your applicant the
City of Coalgate by its attorney
E E Mclnnis and states to the
court the following facts:
more thin two-thirds of the
qualified voters of the pa'd City
holding real or personal property
subject to taxation therein vot
ed to issue and sell the bonds of
the said City in the sum of $44
000 for the purpose of creating
establishing erecting and put-
ting into operation a system of
waterworks for the said City
That the said bonds were issued
by virtue of the authority of the
said election that they have
been sold and that the proceeds
from the said sale are now
available for the said work
3 That in the construction of
the said system of waterworks a
water shed reservior and dam
power house and water tower
are necessary and that there is
no fit place for same within the
corporate limits of the said city
that it is actually necessary tha
the said City acquire the lands
hereinafter mentioned and de
scribed for such water shed
reseryior basin and dam power
house and water tower anc
that such lands cannot be obtain
ed by said City except by con
damnation in the manner provid
ed by law
