WILL NOT REVERSE CASES
ON TECHNICAL GROUNDS
(Continued from 1st Page)
Court refused to reverse the Dis-
trict Court of Kiowa county in
the conviction of A X Byars
for the killing of his wife The
t'-ourt laid down the rule that
injury as well as error must" be
shown before there be a reversal
In bis opinion Justice Furman
says:
“The enforcement of the doc-
trine of harmless error in Okla-
homa will greatly improve the
character of our criminal trials
Lawyers will he compelled to fry
their eases upon their actual mer-
its nnd will cease devoting ao
much time in attempting to force
technical errors into the record
Better resulls will be reached in
the administration of justice and
courts will gaiu the confidence
and respect of the people nnd
acts of mob violence will cease to
disgrace out state ’
"We are very sure that if
the people had implicit confi-
dence in the courts to speedily
enforce the law upon the merits
of each case there would he no
lym hings in this state
“The reversal of just convic-
tions of the guilty upon purely
technical questions is the prime
cause of want of confidence in
the courts This want of confi-
dence often results in mob vio-
lence on the part of a long suf-ft-ung
and outraged public We
have the highest authority for
this statement for we are told
in "the Bible that ‘because sen-
tence against an evil work iij not
executed speedily therefore the
hearts of the sons of men are
fully set in them to do evil’ ”
MT AS BAD AS HE THOUGHT IT
(Continued from 1st Page)
f''Lhave a pretty good 100 acre
farm six miles 'from tluthrie”
said the old man “and it is as-
sessed at $1500 I have consid-
erable personal property hut ow-
ing To the fact that I am a head
of ’’family and have $200 ex-
'eiupuoh I pay taxes on $K)
'personal property making a total
oOisoo’’
‘'You- really think that you
must sacrifice your cotton crop
to pay your taxes?’' said the
‘other man Now just let’ fig-
ure this matter $1800 at two
ind pne-half mills will be $450
Do you think it will be necessary
to sacrifice any cotton to pay
":$150 for keeping up the state
of- Oklahoma?”
‘“Why is that all?” inquired
the old man
“Yes” said the other “and
you must remember that at the
prusent time we are building a
number of large fine new state
institutions including a great
many schools reformatories pen-
itentiaries and asylums and all
of these cost money i Do you
know what your rate of taxation
was for territorial purposes when
the United States government
paid most of the expenses?”
The old gentleman admitted
that he did not
“The last territorial levy was
live and one-half iiills With
your valuation your taxes for
state purposes would then have
been $51)0 If you paid your
taxes then without suerifieing
your cotton you can certainly do
so now that the rate has been
rcihiccd more than one half Now
let me tell you your wife and
children who recently visited their
relations in Missouri traveled in
the state of Oklahoma 205 miles
and you saved on each of your
four tickets one cent per mile
each way or $410 on cadi of
your four tickets making a total
of $1040 Now your entire state
tax is only $450 so that the sav-
ing that the state has made to
you in this little trip is nearly
four times the amount of your
total state tax”
“Well I’ll be darned” said
the old man pocketing the paper
Crooks’ Chill Tonic tastes good
