LEGISLATIVE RESOLUTION #4
OSFA Resolutions Committee:
We, the members of Woodward Firefighters Local 2560 Executive Board
and Resolutions Committee, ask that you consider the following resolution
concerning prevention of communicable infectious diseases we may en-
counter as firefighters (Hepatitis B):
Be it resolved that the OSFA introduce and support legislation to require
all city, county and state agencies that employ full-paid, part-paid or
volunteer emergency personnel be held responsible for providing im-
munizations against communicable infectious diseases for which a vac-
cine is available. Furthermore, any hospital and/or physician treating an
infected person for any injury shall be required to inform all emergency
personnel who may have come into contact with the disease. of his or
her possible exposure to that disease.
A wood carving has been made by Frank King of Bartlesville and they plan
to have a drawing for this piece of art.
WHEREAS seat belts are proven to be a life-saving device,
BE IT THEREFORE RESOLVED the Oklahoma Fire Chiefs Association
support state legislation to require seat belts be installed and used in all fire C)
apparatus in service in Oklahoma fire departments.

WHEREAS: the Louisiana deferred retirement option plan is beneficial to
the retirement system as well as the pension benefits of the individual
members,
THEREFORE BE IT RESOLVED that 11 O.S. §49-106 be amended as
follows:
A. In lieu of terminating employment and accepting a service retire-
ment allowance under §49-106, any member of this system who has not
less than twenty years of creditable service and who is eligible to receive
a service retirement allowance may elect to participate in the deferred
retirement option plan and defer the receipt of benefits in accordance
with this provisions of this Section.
B. For purposes of this Section, creditable service shall include service
credit reciprocally recognized under §49-100.1.8.. but for eligibility pur-
poses only.
C. The duration of participation in the plan shall be specified and shall
not exceed five years.
D. A member may participate in the plan only once.
E. Upon the effective date of the commencement of participation in the
plan, membership in the system shall terminate and neither employee
nor employer contributions shall remain as they existed on the effective
date of commencement of participation in the plan. The monthly retire-
ment benefits that would have been payable, had the member elected to
cease employment and receive a service retirement allowance, shall be
paid into the deferred retirement option plan account. Upon termination
of employment, deferred benefits shall be payable as provided by Subsec-
tion H.
F. (1) The deferred retirement option plan account shall not earn in-
terest. A person who participates in this program shall not be eligible to
receive a cost-of-living increase while participating and shall not be eligi-
ble until his employment which makes him eligible to be a member of
this system has been terminated for at least one full year.
(2) After a person who participates in this program has terminated his
employment which makes him eligible to be a member of this system, for
at least one full year his individual account balance in the plan shall earn
interest at a rate of two percentage points below the percentage rate of
return of the system's investment portfolio as certified by the actuary in
his yearly evaluation report, said interest to be credited to his individual
account balance on an annual basis.
G. The deferred retirement option plan account shall not be subject to
any fees, charges, etc., of any kind for any purpose.
H. Upon termination of employment at the end of the specified period
of participation, a participant in the program shall receive, at his option,
a lump sum payment from the account equal to the payments to the ac-
count, or a true annuity based upon his account, or he may elect any
other method of payment if approved by the board of trustees. The
monthly benefits that were being paid into the fund during the period of
participation shall begin being paid to the retiree.
1. (1) If a participant dies during the period of participation in the pro-
gram. a lump sum payment equal to his account balance shall be paid to
his named beneficiary, or, if none, to his estate; in addition, normal sur-
vivor benefits payable to survivors of retirees shall be payable.
(2 ) If a participant terminates employment prior to the end of the
specified period of participation he shall receive, at his option, a lump
sum payment from the account equal to the payments to the account, or
a true annuity based upon his account balance, or he may elect any other
method of payment if approved by the board of trustees.
BE IT FURTHER RESOLVED that if adopted, this resolution be submitted
to the Oklahoma State Firefighters Association for consideration and/or ap-
proval.

ecutive board has approved a two
year plan where these cities may
send delegates to the business

The Seminar Room of the High Plains Vo-Tech School will be the location of
this important event. ALL RETIRES ARE INVITED TO ATTEND. There is no
registration fee. Please check in at the registration table, however, so we can
get you counted and know you were there. Each year our numbers increase
and we are looking forward to seeing many familiar faces. Any thing you
wanted to know about your pension can be asked because the people who
have the answers will be there. Active firefighters and wives are also invited.
