Boiey:
You and each of you are hereby notified
that:
WHERFAS on the 15th day of April 1925
the Board of Trustee of the Town of Bo
ley Okfuskee County Oklahoma duly
enacted Ordinance No 89 in words and fig-
ures as follows:
ORDINANCE NO M
An Ordinance entitled an Ordinance grant-
ing to Oklahoma Power Company a Cor-
poration and to its successors and assigns
a twenty-five year franchise to buy ac-
quire build own equip and operate an
electric light and power system constat-
inf of machinery pole and wires ap-
pliances substations and attachments for
the purpose of manufacturing and -or dis-
tributing electricity in the Town of Boiey
Oklahoma aad granting the right to use
the streets alleys or other public places
f the Town of Boiey Oklahoma for ouch
purposes fixing the rates which may he
charged for furnishing electric light and
power to the dtisene residents and in-
habitants of the Town of Boiey providing
for the sale of the entire lighting and
distribution system now owned by the
Town of Boiey to the Oklahoma Power
Company except the electric generating
station and plant of the Town and the red
estate upon whkh the same is located
providing for the submission of ouch ques-
tions to a vote of the qualified electors of
the Town of Boiey calling a special elec-
tion ! at which the questions of such 'pro-
posed franchise and sale shall bo submitted
( ' and declaring an emergency

the Incorporated Town of Boiey Okfus-
kee County Oklahoma: '
Section 1 That the Oklahoma Power Com-
' pany a corporation it successors or as-
signs consent to assignment being hereby
pivcn or hereby granted the right priv-
ilege and franchise for the term and period
of twenty-five (25) years from and after the
date when this Ordinance shall become ef-
fective as hereinafter set forth to buy ac-
quire erect equip maintain and operate an
electric light plant and sub-station or sub-
stations in the incorporated Town of Boiey
State of Oklahoma and-or to buy acquire
erect equip maintain and operate over tin
i : der through and upon the streets avenues
alleys highways and public grounds of said
Town as the same now exist or may here-
after be extended or established all poles
wires cables appliances and lamps trans-
formers and all other equipment of every
description and kind that may be neces
sary or proper for the transmission of elec
tricity for electric lighting heating and
Kwer purposes in said Town and to the in
bitants thereof and persons firms and
corporations doing business in said Town
and to furnish --id supply electricity for
'said purpose vp-e holder of this franchise
may manufacture electricity to be furnished
hereunder at a plant or plants located eith-
er within or without the corporate limits as
it may see fit
Section 2 (1)— That said rights privileges
and franchises are granted upon the fol-
lowing terms and conditions to-wit: poles
for said wires shall not be less than twenty-
five (25) feet in total length: and the Board
of Trustees of said Town of Boiey shall have
the right to designate places where said
poles shall be set and establish reasonable
L rules for the regulation of the manner and
Arrangement of said poles and wirest 'pro-
vided said supervision as to the setting of
- poles by the Town of Boiey shall be ex-
ercised m such manner as not to destroy the
rights hereby granted nor to create extra
expense in setting and placing of said poles
(2)— That the said Oklahoma Power Com-
pany its successors and assigns shall hold
the Town of Boiey harmless against all ac-
tions or obligations for injuries resulting
either directly or indirectly from the erec-
' tion operation or maintenance of said
plant sub-satipn distribution system and
j appliances
Section 3 Rates for electric service for
commercial and domestic use subject to the
ftower of the Corporation Commission of Ok-
ahoraa to change the same on the appli-
cation of either pnrty shall he as follows:
General Lighting Rate
Available for all lighting service and for
all motors of less than one horse power and
for appliances of less than one horse power
rated capacity Single phase sixty-cycle

It is understood and agreed that the rates
specified above for each or any month shall
be subject to an addition of five one-hun-drehths
(5100) of a cent net per K W H
for each lc of increase in the cost of gas
above seven and one-half (714) cents per
thousand cubic feet at the Company’s gen-
erating plant during such month and that
if at any time the Company will adopt other
fuel for the generation of electrical energy
which shall increase the Company’s energy
production cost in excess of such cost at the
date of this contract then the Tates here-
inbefore specified for any month shall be in
creased in the same proportion as the Com-
pany's generating cost has been increased
during such month as a result of its re-
quired use of a more expensive kind of fuel
Discount for Prompt Payment
10 percent of the total amount of the bill
will be allowed when billg are paid on or be
fore 10 days from their respective dates
Determination of Maximum Demand
The maximum demand for the month shall
be the highest number of kilowatts in-
dicated or recorded in the fifteen minute in-
terval in which the consumption of elec-
tricity is greater than in any other fifteen
minute interval of the month provided that
in the case of hoists elevators welding
machines furnaces and other installations
where the use of electricity is intermittent
or subject to violent fluctuations the Com-
pany reserves the right to require the cus-
tomer to provide at his own expense suitable
equipment to reasonably limit such intermit-
rence or fluctuation and will base the cus-
tomer’s maximum demand upon a five minute
instead of fifteen minute interval

Special Terms and Conditions
The term of contract shall be for a period
of one year from the commencement of serv-
ice and thereafter until ten days written no-
tice to discontinue is given the company by
the consumer
Section A That the said Oklahoma Power
Company its successors or assigns shall at
its or their expense repair any and all dam-
ages to any streets alleys sidewalks or
crossings and any other damages that may
be occasioned by the erection equipping
uncrating repairing and maintaining of said
plant or distribution system
Section 5 That for the purpose of enabling
the Oklahoma Power Company to carry out
the terms and conditions of this agreement
and ordinance the Town of Boiey by these
presents does hereby grant bargain sell
assign transfer set over and convey and
deliver’ to the Oklahoma Power Company iis
successors and assigns alt of the property
of the Town of Uoley used or formerly used
or owned or held for us as' a part of or in
every sort whatsoever constituting or ‘heing

Section 6 The franchise granted by this
ordinance shall not in any event be construed
to be an exclusive franchise but a part
of the sale of the electric plant of the Town
of Boiey it ia agreed that the Town of Bo
ley in no event shall lease or sell ita elec-
tric generating plant to any person -whomsoever
for use in the generation of elec-
tricity to be sold to the citisens and resi-
dents of the Town of Boiey or to the Town
itself so long as the rights and privileges
of Oklahoma Power Company based upon the
franchise hereby granted shall continue ir
effect title to such generating plant how
ever shall remain in the Town of Boiey
otherwise unaffected hereby
Section 7 Upon the approval of the
franchise and sale herein authorised at an
election called as hereinafter provided and
upon the acceptance by Oklahoma Power
Company of the terms and conditions of said
franchise and this ordinance and upon pay-
ment of the consideration of $225000 here-
inabove provided the President of the Board
of Trustees and the Town Clerk of the
Town of Boiey are hereby authorised and
directed to make execute and deliver to the
Oklahoma Power Company appropriate bills
of sale and conveyance in the name and be-
half of the Town evidencing this sale and
transfer
Section 8 Those portions of this ordinance
granting a franchise to the Oklahoma Power
Company and authorising the sale of prop
erty of the Town of Boiey to Oklahoma
Power Company shall not be in force and
effect unless the same shall be approved at
a special election notice of which ia hereby
given which is hereby called to be held in
the Town of Boiey Oklahoma on the 26th
day of May 1925 of which special election
for such purpose thirty days1 notice shall
he further given by the President of the
Board of Trustees and the Town Clerk by
proclamation accompanying the publication
of this ordinance nor unless within twenty
days after the result of such election shal
be lawfully declared Oklahoma Power Com-
pany shall file with the Town Clerk iti
written acceptance of such franchise 'and
sale and shall pay to the Town Treasurer
$225000 as above provided the twenty-five-year
term of this franchise shall commence
upon the filing of such acceptance and the
ayment of such sum and the failure of Ok-
ahoma Power Company its successors or
assigns to accept this ordinance and make
such payment within said period shall be
deemea a rejection thereof and the rights
and privileges herein offered including both
said franchise and sale after the expira-
tion of said period of twenty days if not so
accepted shall absolutely cease and de-
termine Section 9 An emergency is hereby declared
to exist whereby for the protection of the
public peace health and safety this or
dinance shall be in full force and effect
from and after its passage and approval

thereof granting said franchise and author-
izing said sale to Oklahoma Power Company
should not become effective unless approved
by a majority of the qualified electors res-
ident of the Town of Boiey voting at a spe-
cial election which was by said Ordinance
called to he held in the Town of Boiey on
the 26th day of May 1925 after thirty days’
further notice given by the President of the
Board of Trustees and Town Clerk as pro
vided by law for holding such elections:

terms and provisions of said ordinance and
to the authority vested in me by law I
hereby call and proclaim that there shall
he held in the Town of Boiey Okfuskee
county Oklahoma a special election on the
26th day of May 1925 at wl)ich such spe-
cial election there is hereby submitted to
the qualified electors residing within the
corporate limits of the Town of Boiey the
questions of the approval of the above and
foregoing franchise and sale of said prop
erty

special election shall be evidenced by the
ballot title of the ballots which shall be
prepared by the Clerk of the Town of Bo
ley and submitted to such electors The bal-

ley grant to Oklahoma Power Company and
its successors and assigns a franchise for-a
period of twenty-five (25) years from and
after 'the acceptance thereof to buy acquire
build or equip and to operate and maintain
a system of works machinery and prop-
erty in the Town of Boiey for the purpose
of generating and-or distributing and selling
electric current for light heat and power

years all as set forth in Ordinance No 89

PROCLAMATION
Whereas the sons of Oklahoma loy-
ally served their State and Nation
in the world war and by their deeda
of sacrifice valor and ’devotion
wrote the name of Oklahoma on the
highest pinnacles of fame and
Whereas these veterans have in
this same spirit of loyalty exempli-
fied in the days of 1917 - and 1918
continued to serve the State and Na-
tion ever upholding the principles of
Americanism and combating to the
utmost of their ability all forms of
disloyalty and have stood as a bul-
wark for the principles of patriotism
freedom and brotherly love upon
which our country was founded thus
setting a living example of loyal citi-
senship and
Whereas the unselfish endeavors
of these young patriots in caring for
the war’s disabled the orphans of
their comrades and their untiring
work to make their communities bet-
ter places in which to live has in the
past and continues to be an inspira-
tion to all loyal citizens and
Whereas it is fitting that their
great service in war and peace should
be recognized by the citizens of this
great commonwealth
Now Therefore upon the request

Ground Limestone for FortBisor
Toot
A car load of ground limestone is
being unloaded this week at Okemah
under the supervision of the county
agent This lime is going to several
points in the county Ten tons is be-
ing used by Camp Brothers on Irish
potato land several tons ere being
used by the gardeners and truck
growers around Okemah George El-
liott west of Okemah is using some
on land that he plans on putting in
alfalfa J W McMillan will use
several tons on alfalfa land Dug
Sharp is using 20 ton on small grain
and sweet clover ground that he
plans on putting in alfalfa later
This car of limestone was donated
by the Bromide Crushed Rock com-
pany of Bromide costing those get-
ting it only the freight of 8112 a ton
i The Hughes Stone company of
Tulsa ’has donated a car that will be
used by John Core on alfalfa land
and by Dug Sharp on alfalfa land
While local tests are limited yet in-
formation at hand indicates that most
of the land in Okfuskee county would
be improved by the use of lime
Feed 1 First
With the livestock outlook getting
better it is doubly important that
plenty of feed should be raised this
year Farmers that are studying the
economic situation are looking for
crops to take the place of cotton this
year Surplus feed this year should
be profitable both as a cash crop Bnd
when marketed in the form of live-
stock Moisture conditions do not war-
rant an increase in the corn acreage
There are two crops that deserve
more consideration at the hands of
the Okfuskee bounty ifarmers They
are peanuts and kafir corn both of
which do well on our poorer land
and ’ stand considerable hot dry
weather There is always a fair mar-
ket for peanuts and the vines make
excellent hay Most people know
something of the value of kafir as a
forage crop but less about it as a
grain crop Kafir has practically the
same feed value as corn when ground
and is also fed in the head with ex-
cellent results As a cash crop kafir
is growing in importance every year
It is one of the principal grains in
poultry industry and more kafir be-
ing used in other mixed feeds it is
getting to have a place as a cash
crop In case of doubt plant kafir
corn
The Corn Evil
The boll weevil or the corn evil —
it is hard to tell which cost the Ok-
fuskee county farmers most Corn is
the easiest grown harvested and
stored crop we have and therefore
the most popular So most farmers
lay their farm off into two patches
one is corn ground and the other is
cotton ground If cotton fails they
do not have anything to pay their
debts with If corn fails they have
to go in debt for work stock feed
half feed the milk cow and nearly
starve the chickens and sell the
young stock for one-third what it
would bring if fat
Even if we do raise a good crop of
corn corn lacks a lot of being the
patent medicine cure-all that the av-
erage feeder tries to make of it It
is not a balanced ration Yet if we
could always raise a good crop of
corn I would not be so excited Ok-

county I get new evidence of the
popularity and value of peanuts as a

farmer doing what I thought a VCTV

third row of corn and is goinp to

county are putting every other
row Peas ' n 'J corn Cow pea hay is
a feed hard to bent Then there is
a good profitable market for the-
peaa To say nothing of the added
value to the land in growing e pee
crop There is an old saying that
“Alfalfa is corn and hay both’
Cow-peas and peanuts are the poor
man’s alfalfa
- This year our motto should be less
com more kafir Every year it
should be more cow peas and -peanuts
