In dealing with the Constitu-
tk n of any state it is only fair to
examine it critically and see if it
is in keeping with the people of
tl e state and when in use will
bring results sought for and will
leave the power properly reposed
in the people the true source
and support of all free govern-
nents If this be accomplished
and all of its provisions are
fashioned to that end then we
have a constitution that is indeed
worthy of universal approval
Let us examine some of the most
important provisions and those
the people have clamored for
since fair Oklahoma was inhabit-
ed by liberty-loving ambitious
citizens
First: We find the initiative
and referendum it being a pro-
vision which will enable the peo-
ple to be as sovereign with ref
erence to good legislation as
the stump-speaker always tells
them they are It will enable
the common people acting in un-
Lon and in accord to have and
obtain such legislation as will
best serve their wants needs
a id desires It w'ill free the
members of every legislative
body from the lobbies that act
y holly and solely to thwart the
will and honest desires of even
the legislators themselves and
nuch more is the same true of
the masses of the people and
their true interests It enables
the people to remove and obliter-
ate unwholesome legislation that
has or may creep into the statute
books either by caprice or neg-
lect I submit it does this and aye
many times more for the Okla-
homa citizenship and that is
wisely within tbe Constition
just to be submitted for approv-
al Second: We find a Railroad
Commission bill: A measure
that has been tbe battle cry of
Oklahoma and her citizenship
for 18 years of Oklahoma’s existence-
It is that one measure
that would be supported at any
time by 99 percent of the voters
of this state if they but had the
chance to vote for it it is tb President Roosevelt Refuses Succor to the
same measure that has been as-
tutely avoided and turned down
by the eight Republican legisla-
tures of the past and let pains-
takingly alone by every chief ex-
ecutive of the carpet-bag stripe
It is that one specie of legislation
that has been sought for by ev-
ery honest citizen who was dis-
interested and only thwarted by
the railroad interests and their
many unholy practices employed
to accomplish those ends This
is in ‘our Constitution and the
measure is free from holes or de-
fects for it is not left to any
When the constitution was filed
with secretary of the territory
an injunction was run on it im-
mediately which was made per-
manent by Judge Pancoat of
Alva and it seemed that state-
hood was doomed '

Third: The Fellow-Servant
law: That is one law sought for
so long that the memory of man
runneth hardly to the contrary
that law that permits husband
less wives and fatherless child
ren to recover from careless cor-
porations who neglectingly con
duct thsir business at the ex
pense of human life that law
that permits them to recover
such sums as may enable them
to be educated and kept from the
pangs of hunger sorrow and ig-
norance Lo! it does this and
aye many times more It per-
mits thinly-clad children with
tear-stained faces daily awaiting
almost by the side of an open
coffin at the depot of incoming
trains and at the brink of tbe
coal mines to be educated and
made better men and women
and I submit this as a laudable
end for the children of today are
but the men and women of a com-
ing morrow- Let us thank the
Constitutional Convention for
this law if for no other
Fourth: We find it provides
for a board of public charities

We may say it is an expense to
the tax-payers but where is that
man and from whence does he
come who is not willing and tru-
ly so to in all things share the
unfortunates’ burden and there-
by lift aloft down-trodden child-
ren manhood and womanhood
wherever found Unfortunate
circumstances may come home
to ns all and let each one share
the responsibility of the poor lit-
tle waif and unfortunate ones
who are but our own fltsh and
blood

but it was a deadener
President Murray will wait un-
til June 5tb ' and if Governor
Frantz does not call the election
by that date Murray will issue
the call

Cold Refreshments
The new soda fountain has ar-
rived and was being installed
Thursday in the building with
Allison’s jewelry store Mr Alli-
son intends to begin serving ice
cream this week and all other
cold drinks and dishes will be
added as soon as possible
One of the best and latest im-
proved fountains has been ob-
tained which with the ice cream
department in tbe rear and the
arrangement in the building will
make an appearance which would
do credit to a town much latger
than this but Mr Allison thinks
there is aothing too good for his
customers-
Box Supper
The Young Peoples Union of
the Baptist church held a box
supper in the eld Peoples Bank
building Monday evening
The boxes were auctioned off
y J- N Wolff ad the proceeds
netted the sum of $709 The
supper was held for the pur-
pose of raising money to buy a
ibrary for the use of the Union
All who attended had a very
enjoyable time

kind of legislation? It is a law
fresh from the people and fash-
ioned for them Let the stamp
of approval be placed upon this
wise provision by Oklahoma’s
fair citizenship
Sixth: The Constitution we
are soon to adopt recognizes
richly indeed that class of people
who toil from early morn to close
of day They have granted tbe
wishes of the people who lie
down at night with tired mus-
cles but consciences clear clean
and free from premature gray
hairs I refer to the laboring
class of people who throng this
land and tbe eight hour law is
given to them by Oklahoma’s
Constitution-
Oklahoma’s Constitution
should be adopted because it
places such reasonable regula-
tions on corporate greed and
grasp as they have for many
years richly merited by their
conduct It makes submit to the
same rules of taxation that each
individual citizen enjoys It
deals not unfairly with them
only makes submit to such regu
lations as the individual cittizen
enjoys
It should be adopted and ap-
proved by all the people of Ok
lahoma unless it by the present
appointees who have reached the
only political preferment they
will ever enjoy through sources
of appointment and not only the
choice of American voters It
should be adopted by every citi-
zen and all conscientious corpo-
ration who are willing to submit
to fairness and decent control
and the only corporate interest
who is licensed to refuse it the
support it richly merits is the
corporate interests who have
pillaged and abused fair Okla1
homa citizenship for tbe past
eighteen years Only they that
expect to go with the heavy hand
and who are antfous to contin-
ue so to do forever and forever
It should b adopted by the

to that land from whence no

such honest mistakes as they
have made and branded as the

Died ef Pneumonia
Dock Brumbalow died at his
home about foui milts northwest
of this city last Tuesday after a
three weeks illnassof pneumonia
and was hurried Wednesday in
the Baptist Mission cemetery
The deceased was a cousin of
Mrs P N Frazier of this city
and besides whom he leaves a
wife and several children to
mourn his death
Barber Shop Moved
Geo Smith has moved his
barber shop to the next build-
ing west of his former location
in order that J B Allison could
have the entire building in
which to fix up his ice cream

stitution and Questions Now Be-
fore tbe People— Candidate
Por Attorney General
A Democratic rally was held
in this city last Friday night in
the old Peoples Bank building
and a large audience greeted the
speakers of the evening
The first speaker was C M
Howe of Arapaho Custer county
Oklahoma who is seekiug the
nomination for the office of state
treasurer
Mr Howe isone of the pioneers
of tbe territory of Oklahoma
having lived there longer than
any other man who is running
for state office and is now treas-
urer of Custer County
While Mr Howe is not aselo-
quent a speaker as some yet he
has hold of the vital facts of the
campaign and tells them in a
clear concisive way He is a man
in whom right is deeply rooted
and from cverjr view point is
worthy of the office he seeks but
about all hs is an enthusiastic
Democrat and has spent much
time in party harness
The next speaker introduced
was John H Pitchford of Tahle-
Mr Parmer of near Siloam
Springs was in Westville Sunday
going on to Muskogee Monday
morning after his son who had

Judge Pitcbford is a good
speaker and done his share to-
wards entertaining the audience
mixing his sound arguments on
the constitution and the duties
of a jndge with just enough
jokes and funny sayings to keep
the company in the best of hum-
or and hit talk was relished by
kHwho heard it
The judge is a Democrat of
the first water and for the past
quarter of a century has been a
member of the bar the duties
of which eminently fit him for
the position to which he aspires
Every vote cast for this gentle-
man will be appreciated and if
he becomes the judge of this dis-
trict his duties will be conscien
tously discharged-

Mr Freeling is a most enter-
taining talker and is the most
eloquent speaker who visited
Westville during this campaign
His argument on statehood and
the constitution contained sound
doctrine and a clear insight into
the nature of that document
The initiative and referendum
one of the most important clauses
was discused at length and ex-
plained to the satisfaction of
many who did not before
thoroughly understand it
Some of the other points touch-
ed upon where: An elective rail-
way commission a just and
reasonable fellow servant law an
eight hour day for labor and a
measure guaranteeing freedom
within our state from govern-
ment by injunction
The feature dwelt uqon at
length was tbe fact that the pro-
visions of government in the
constitution was practically the
sams as has been in force in the
tribal government of the Chero-
kee Indians and which always
gave excellent satisfaction
Mr Freeling closed his talk
with a strong plea for the
adoption of the constitution even
if it does not suit in every parti-
cular as it is impossible to change
it at any time by a vote of the
people — and also after that had
been done he then wanted to be-
come attorney general n which
office if elected he would stop
graft of every sort and run all
boodlers from tbe state doing
everything in his power for the
right and wants of the people if
they would give him laws by
which to act
