In the July '23 issue of the
- Star-Gazette we find an article
J condemning the city council for
' trying to conserve the resources
! of the municipality by publishing
only what the law required— the
'estimate and financial report—
thereby saving the town almost
one hundred dollars and at the
same time complying to the letter
‘ of the law governing the required
publication
In the same issue is an article
’ i commending the county officials
I for doing exactly the same thing
for the same purpose Listen to
! the fair and impartial “judge”
“Regarding the county esti-
mate we feel confident that Coun-
! ty Clerk Blackard and the county
commissioners have made a sub
stantial compliance with the law
t and that any omissions made by
' them have been prompted wholly
- by a desire to economize and that
i they have not allowed that desire
v i to endanger the legality of (he
county levy”
: We agree with him in this but
-)’ we do not agree with him when
he says that the city officials made
I the same “omissions” without the
same good reason In regard to
f the city officials he says—
' “Here we find an entirely dif-
j ferent condition prevailing In
' our humble judgement neither
t the letter nor the spirit of the law
j has been complied with and we
: entertain grave doubts as to the
I legality of any tax levy that may
be made under the present condi-
tions”
! Now how is this for a square
j deal and an impartial view from
ja paper that for years- has been
j nursed at the city teat and getting
j all the milk?
’ Now “old Bossy” is dry and
I just because she knows the milk
j is gone and won’t stand for a con-
tinual hunch the ungrateful nurse-
1 ling turns and delivers a parting
kick at her emaciated frame
The Boaid of County Coinmiss
ioners ordered and the County
Clerk prepared a condensed fi
nancial statement of the estimate
as required which was published
in the Star-Gazette The city of-
ficials'prepared a like estimate and
financial statement and instructed
the City Clerk to get bids on the
work and have it published in the
paper that made the lowest rate
The Star-Gazette made a bid of
seventy-five cents per square for
the first and fifty cents the second
insertion The Sequoyah County
Democrat bid forty cents for the
first and twenty-five cents for the
second insertion and was awarded
the work
Evidently this peeved the gen-
tlemen of the Star-Gazette to the
extent that they now ‘‘entertain
a grave doubt as to the legality
of the city tax levy
- For the information of some of
the tax-payers of Sallisaw who
may be interested to know the
the extent of the city’s printing
bill we are publishing a statement
of the warrants paid to the Star-
Gazette and publishers from May
1913 to July 1915: 1
The amount runs to the sum of
$1184 49 and some of the items
are quite idleresting reading
' For instance in August 1913 is
a charge of $3750 for printing
ordinance No 198 We have not
taken the time to look up this or-
dinance but we are satisfied that
it is in the book of city ordinances
that was published by the Star-
Gazette in July 1914 at a cost to
the city of $460 apiece
We think that the Star-Gazette
should feel very friendly towards
the town of Sallisaw If for- no
other reason the thoqght of th at
fifty dollars per month that has
been extracted for years with
painful regularity from the de-
pleted exchequer should makt
them hesitate before they tear up
the City Charter and attempt to
invalidate this years (ax levy
We believe in “tracking the law’’
but we alsa b-lieve that it is high
time for the city to sidetrack use
less expenditure and give the
poor tax payer a breathing spell

1915 the above entitled cause
coming on to be heard before the
District Judge John H- Pitchford
in chambers in the City of Tahle-
quah in the County of Cherokee
Oklahoma pursuant to notice
given and plaintiff appearing by
his attorney Joseph I Pitchford
of the firm of Curtis & Pitchford
and the defendants Charles C
Manker E Bee Guthrey appear-
ing in person and by their attor-
ney T F Shackelford and de
fendant M S Blassingame ap-
oearing by his attorney T F
Shackelford both parties being in
court defendants -file a demurrer
to plaintiff’s petition ' which is
after being considered by the
Court over-ruled to which de-
fendants accept Thereupon the
defendants filed response to plain-
tiff’s petition and plaintiff files
eply to defendant’s response and
both parties annoulf e ready and
the Court after reading the plead-
ings and hearing the arguments

m the premises makes the follow-
ing judicial findings:
The Court finds: That the
plaintiff C B Johnson is the
iwner and publisher of the Se
quopah County Democrat a week-
ly newspaper published at Salli-
saw Oklahoma and having a
bona fide circulation in the County
of Sequoyah Oklahoma and the
Court further finds that the de-
fendants E Bee Guthrey M S
Blassingame and Charles C Man-
ker are publishing a newspaper
purported to be the Sequoyah
County Democrat and that the
S9me is unlawfully being publish-
ed by said defendant the Court
further finds that the plaintiff C
B Johnson is entitled to the re-
lief prayed for in said petition
It is therefore - adjudged or-
dered and decreed by the Court
that the defendants Charles C
Manker E Bee Guthrey and M S
Classingame editors agents em-
ployees and assigns are restrained
and enjoined from publishing said
“purported” Sequoyah County
Democrat that they and each of
them be further enjoined and re-
strained from in any way solicit-
ing collecting or otherwise hold-
ing themselves out or represent-
ing themselves to the public as
being the editors or publishers of
said Sequoyah County Democrat
orfoliciting subscriptions or pat-
ronage of any kind or nature
thereof or in any way interfering
with the property of said Tequoy-
ah County Democrat whether the
same be tangible or intangible
pending the final result of this

ma Judge John H Pitchford
found that there was only one
legal “Sequoyah County Demo-
crat” being published in Se-
quoyah county Oklahoma and
that the legal paper was the one
that was being published by C
B Johnson This ease in which
the above was decided was an in-
junction suit brought by C B
Johnson vs Charles C Manker
M S Blassingamb and E Bse
Guthrey for the iur0u33 of en-
joining them from publishing the
Sequoyah C vinfy Dirrtocrat In
their response they claimed some
interest in the paper and deman-
ded a jury trial which was grant-
ed and the property rights of the
paper will be filially decided in
December 1915 The defen I ints
were however enjoined from in-
terferring with the publication
owned by C B Johnson ui
were further restrained from o ib-
lishing a Sequoyah County D m-
ocrat as more fully appears from
said order which is publish c 1 in
this week’s paper
By thi3 decision from which
there can be no appeal the C iurt
has found that there is only one
“Sequoyah County Democrat” and
that it is o vned and edited by
C B Johnson and that its legal
status ha3 not been changed by
the fact of the mortgagees taking
no3session of the paper and sell-
ing same under the terms of the
mortgage The only question to
be determined in December is
who is entitled to the paper C B
Johnson or the defendants Man-
ker Guthrey aud Blassingame
and not the legal status of the pa-
per as this question has been
judicially determined

The American steamer Leelan-
aw was sunk by a German subma-
rine off the Oikney Islands Sun-
day night July 25th The steam-
er was stopped and after her

ficials are under arrest
The excursion steamer East-
land capsized in ’ the Chicago
River last Saturday nnd 1200 peo-
ple were drowned mostly women
and children
