entry No. 9465, made Sept. 13, 1902, for

range 10 west, I. M., by Perry V. Mer-
rick, contestee, in which it is alleged
that entrynian has never made settle-
ment. has never made any improvement

abandonment for the period of six
months and more and said 'efault still
exists, said parties arc hereby notified
to appear, espond and offer evidence
touching said allegation' at 10 o'clock
