ing to argue the appeal case of Mary E. Linduff, 3 years.
Geo. Foster before the criminal
court of appeals. They are ask-
ing a reversal and a new trial,
and have some hopes they will
secure it.
Foster is in jail here await-
ing the outcome of the appeal.
He is under sentence of 18 years
in the penetentiary for the kill-
ing of Ed Greenhaw, which oc-

as night-watchman at the Uni-
versity, at a salary of $60 per

cisco court yesterday under the

K. Updike, ex-Gov. Haskell's
nephew, of the murder of A. O.
Ohristianson. The killing oc-
curred on Jan. 15, 1911, when
Updike kliled two men at his
home in Oklahoma City—Chris-
tianson and P. D. Anderson. He
was convicted of the Anderson
killing, and sentenced to life im-
prisonment, but Lieut. Gov. Mc-
Alester, in the absence of Gov.
Cruce from the state, pardoned
him. He was at once re-arrest-
ed for the Christianson killing,
and held for trial. This acquit-
tal makes him a free man.
