Okla. Sept. 20. Civil efforts take
precedence over military court-martials
even In times of war except In
districts under marital .law or by
ppecificatlon of the president accord-
ing to statements from the office of
Oeneral Snow port commander of tho
military reservation at Fort Sill.
Tho three soldiers members of the
fourteenth field artillery urrested in
Oklahoma City on the charge of steal-
ing an automobile and sentenced to
Bcrve a year at the state penitentlury
at McAlcster cannot be released on
the demand of the authorities here.
Their release Is not desired by Oen-
eral Snow upon receipt of official in-
formation from the county attorney's
office they will be dlshororably dis-
charged from the army.
A guard was sent yesterday to Ok-
lahoma City to bring the men to Fort
Sill. This action was taken following
a letter from Assistant County At-
torney Morgan nsking whether the
men should be returned to the post
for court-martial.
JURY IS UNABLE TO AGREE
After Six Hours' Dclilicrution Men
Are Discharged; Suit for $20000.
By a six to six vote the Jury In the
suit of li. E. Caruthers ugainst the
Bessemer (as Engine company dis-
agreced as to the question of liubllity
last night and was discharged. They
were out about six hours when they
reported that they were unable to
agree.
The suit Is an old one. having been
In court for the past six years. It was
filed shortly after Caruthers. who was
a brukeman on the Frisco railway
fell from a freight car on which he
was riding and sustained the loss of
a-leg. ills suit for $10000 damages
was brought on the allegation that his
fall was due to a wire stretched across
the track and that the engine com-
pany was responsible for the wire be-
ing there.
Testimony at the trial was conflict-
ing. One witness stated that the fall
undoubtedly was due to the wire
whilo others said that to their knowl-
edge tho wire was tot high to strike
even a man standing on the top of a
car.
The case being an old one prob-
ably will bo advanced for retrial the
latter part of October.

commissioners today appointed Claude
C. Taylor Sapulpa banker to super-
vise the taking of a census of Crees
county. Work is to be starteu at
once. It was said.
An appropriation was made by tho
county at the time the estimates were
prepared of $11000 to carry on tnu
work and this was approved by the
excise board. It Is expected that t.io
great Increase In population will have
the effect of Increasing the salaries
of nearly all county officials.
Not since 1910 has a census been
taken In the county and at that tinio
the population was only a little more
than 26000.

day. Near the Hock Creek school-
house Hatton and two playmates

which when the brakes became

runaway cars were seen by the en-

leg. He was taken to the Oklahoma
hospital at Tulsa.

The wreck occurred near the water
station pumping plant Just west of
the city. The passenger arrived hero

up some of the lost time.

here 161 in all. a Bleat patriotic fare-
well today. The boldiers left for
Camp Travis San Antonio. More than
five thousand people were at the Un-
ion station when they departed bust
night. The soldiers were guests at a
big dinner given at tho Mairo hotel.
Members of the engineer corps from
hero who are stationed at Independ-
ence Kan. came to Hartlesvlllo to
take part in the celebration. They
were In chargo of Capt. "Hob" Iwis.
