will to probate came up whin creditors
asked the district supremo cou« to ap-
point collectors of Colonel McKays es-
tate. alleging delay on the part of tne
executors in probating the will. There-
upon, Admiral Hichborn. repr-aentlng the
daughters, asked for the probat* of th*
will, u also did Ual.fl Or.cs McKay,
who iu married to Col McKay •hortlT
b«(ore his death, and wlio claimed that
the domicile of the deoeaaed was Okla-
homa. Mrs. Jennie Pope McKay, how-
ever who asserts *.hat she is the lawful
widow of Col McKay, filed a caveat to
the will, alleging Washington as the resi-
dence of Col. McaKy, and consequently
maintaining that the decree Issued by the
Oklahoma court divorcing her from *-oi.
McKay was void. Justice Anderson took
the questions of appointment of collec-
tors and Mrs Jennie McKay caveat to
the will under consideration, rendering
his decision yesterday. In concluding his
opinion, he said:
"Admitting for the sake of the argu-
ment. that Jtnnle Pope McKay is the
lawful widow of Nath.t^^l McKay, de-
ceased and as such, has^pecunlary In-
terest in his estate under the circum-
stances of this case she Is not entitled to
caveat this will, as h«- right to share in
his estate as such widow—if she be such
widow—is In no wise affected, whether the
will stands or falls, and, therefor*, her
alleged cav*at. b«4ng thus eliminated
from the case, it is not only the right,
but the duty of the court to admit sa d
will to probate, which I* accordingly
done."

New York, July 7—A Sandy Hook
calm familiar to cup racers, prevented
more than a brief trial of the two
Shamrocks today but an hour's wind
work in a very light wind offered the
new boat an opportunity to demon-
strate again her wonderful drifting
qualities. The boats started with the
Shamrock 1 100 yards to windward ot
the challenger, on the Shamrock s I'a
weather quarter. Pointing higher and
footing faster, the new boat worked out
rindward and 45 minutea after the
start was an eighth of a mile to wind
ward of her. Then the wind died away
a calm and at 3:10 the trial was
abandoned.
