Nowata, Okla.—Nowata is under
firms. In the county Jail are held
' Pone Poe and Bob Childress, believed
to be members .of the bandit gang
whose during bank robberies and
deeds of outlawry culminated In the
slaying of Charles Bullock, city mar-
shal of Delaware, and Johnnie Garret-
son and wounding of Ed Garretson,
perhaps fatally.
Poe was placed In the Nowata
county Jail on a warrant charging
complicity in the Aluwee bank a few
] weeks ago. Childress, a negro, was
arrested by a posse suspected of
having knowledge of the bandits who
participated in the battle.
Bullock aud Garretson were killed
in a p'tched battle between a citi-
zens' posse and fifteen bandits, eigh-
I teen miles northeast of Nowala. The
dead and wounded were members of
the posse, which was routed by the
bandits, believed to be the Roe-Hart
gang of robbers that has terrorized
j the hanks of northeastern Oklahoma
for several months.
Nowata is in Nowala county, In the
northeastern part of Oklahoma, and
in what is known as the Osage Indian
country. About seven miles north of
Nowata is the town of Delaware, and
east of Nowata Big creek Howb into
. the Verdigris river.
With Nowata and Delaware as the
base line, the battle occurred at what
would be the apex of a triangle, pro-
jecting east to the confluence of Big
: creek and the Verdivris river, 'l'ho
J country in that vicinity is cut with
canyons and covered with "black-
jack" timber. It is sparsely settled.
: Garretson Brothers' store at Dela-
ware was robbed last week. Next day
a traveler reported at the store that
lie had counted fifteen men, heavi'y
j armed, camped in the Verdigris river
bottom. Word was sent to officers
at Nowata.
A posse was organized at Delaware.

DESPERATE BATTLE STAGED | and state institutions during the next
two fiscal years, beginning July, 1917,
according to recommendations of in-
stitution and department heads, set
forth iit Governor Williams' biennial
message to the legislature, transmit-
ted to both brauches of the general
assembly.
Only a comparatively few subjects
are proposed by the governor for legis-
lation, and for the most part these
are considered by legislators as of
minor importance. His message, com-
prising fifty-five long typewritten j
pages and accompanied by exhibits
presenting statistical data and other
information on the operation of the
government, is said by legislators to j
contain fewer recommendations for I
legislation than any message yet >
transmitted to a regular session of the
Oklahoma legislature.
Apropriations to cover deficiencies i
which had to be created in some of the
departments and institutions and a
detailed explanation of the needs of
these deficiencies constitute a liberal
portion of bis message. On every sub-
ject touched upon the governor, par-
ticularly upon expenses, he lias ex-
ercised great care in transmitting to |
the legislature all of the information
available bearing upon the subjects
discussed. The governor hopes the
legislature will be supplied with all
of the information needed in determ-
ining the cost of the running of the
state government. His message is
said to be a long step in the direction
of the establishment of the budget sys-
tem for the state government.

During the past few weeks banks
have been robbed at Vinita, Nowata,
Skiatook and Alluwe. At Vinita
nearly $20,000 was secured.
Guard Kept at Jail.
An attempt at jail delivery similar
to that at Vinita a few weeks ago,
when two members of the I'oe-Ilart
gang were liberated, is considered a
possibility.
Members of the posse which scoured
the Cedar Hill country northwest of
here without locating the main band
of outlaws are guarding the court-
house. Practically every gun in
town is loaded and placed ready at
hand. The body of Bullock was
buried at Delaware. Two small chil-
dren and a young widow survive. The
body of Johnnie Garretson was taken
to Delaware. While his condition- is
regarded as extremely serious. Ed
Garretson has a fighting chance for
life, his physicians say.
Of the bandits who killed Charles
Mullock, city marshal, and Johnnie
Garretson and wounded Ed Garret-
son, not one is expected to be taken
alive. The ruthless manner in which
they mowed down three members ol
the little posse and the persistencp
with which they pursued the sur-
vivors, leads officers to believe that
mercy will neither be given or ex-
pected—that it will be a fight to the
finish.

the supreme court commission, which
expires the last day of January. Sev-

mended by the several boards or heads
for the fiscal year closing June 30,
1918, aggregate $3,538,977.81; for the
fiscal year clo ing June 30, 1919, aggre-
gate $2,458,830.60. For each year add
$1,500,000 for expenses of state gov-
ernment and you would have right
around $5,000,000 appropriated for tho
year closing June 30, 1918, and
$4,000,000 for the year closing June
30, 1919, If appropriations are made

Hurley Quits Trade Commission.
Washington.—Edward N. Hurley,
chairman of tho federal trade com-
