county clerk, treasurer and county
commissioners of Kingfisher county
on account of said officers having been
indicted by the grand jury. The case
was argued pro and con by the best
legal lights of Kingfisher
The court decided that under the
statutes passed by the last legislature
it had no authority to suspend said
ofheers from duty without the ex-
pressed will of the grand jury finding
the indictment: in other words, the
new law makes it the duty of the
gram' jury to recommend the removal
of such officers when Indicted; in the
absence of such recommendation the
court has no pow r to act. The court
further held that the removal of said
officers under the circumstances would
naturally create a precedence against
them when their cases came to trial
under said indictments.
Therefore under the ruling of the
court the Kingfisher officers will con-
tinue to serve in their official capaci-
ties until they are tried, convicted or
acquitted under tie charges preferred.
