penses resulting from contests as to
other property.J'
The foregoing circular of instruc-
tions has never been abrogated,
changed or modified but is stili in full
force and effect for the guidance of all
townsite trustees in discharge of their
duties.
If this circular moans anything it is
that tho townsite board shall assess
against tho lots embraced in a town-
site, all the expenses incurred, includ-
ing government price of land, money,
salaries, etc., up to the time the board
is prepared to deliver deeds for the
uncontested lots and that all ex-
penses, by reason of contests, in-
curred after that time shall be paid
by those who render tho further ser-
vices of the townsite board necessary.
Had townsite board No. 8 followed
the instructions above recited in
levying the assessment for expenses
of proving up and deeding the lot* in
the city of Perry there would have
been no complaint against their
action, but their plan of proceedure
is so at variance with the express in-
structions of the department and, in
its practical operation, so inequitable
and unjust that dissatisfaction has
been general from the outset.
Instead of following the instructions
cited the expense of proving up and
making deeds has been estimated on
tho basis of about two and a half
years' employment for the board,
i hat is, those who have lots on which
no contests exist and can now take
out deeds for their property, are
compelled to pay their pro rata share,
not only tho expense of Una! proof,
price of land, salaries and other ex-
penses of tlu* board, up to the time
the board was ready to issue deeds in
accordance with the "notice publish-
ed,1' but the owners of uncontested
lots are charged with their share of
the salaries and expenses of the board
for a period of two years and a half or
more beyond the time the board was
prepared to issue deeds for lots not in
contest, that expense being about *30
per day during the entire time.
Townsite trustees are paid in the
same manner as all other per diem
officers ot the government, for the
time actually engaged in the discharge
of their duties. They have no right
to expect ot receive compensation
for a single day when not so em-.
ployed. Realizing the hardships and
burdens imposed on lot claimants the
