Frederick, Okla., Oct. 3.—J. L. Lair,
a banker of Frederick, Is the defendant
in a number of law suits growing out
of the matter of the townslte of Fred
erick. The Frederick Townsite com-
pany was organized late In the year
1902. They platted the townsite of
Frederick, in the southwest part of
Comanche county, which waa only one-
half mile from the townsite of Ha-
zel. The Frederick townsite people
began to sell their land. Later in the
deal Mr. Lair became the successor
to the land, consequently the suits are
filed against him. These suits grow
out of the fact that Hazel, the early-
day town, was totally abandoned.

Perry, Okla., Oct. 3.—Judge Halner
of the Fourth judicial district of Ok-
lahoma has made public through a de-
1 -ion recently handed down in the
case of the United States vs. Clarke
his legal reasons for upholding the va-
lidity of the common law method of
securing a jury. The opinion quotes
a number of eminent authorities and
goes quite exhaustively into the mat-
ter. It is given in part as follows:
In accordance with the provisions
of our statute, within ten days before
the convening of this term of court
I made an order to the clerk of the
district court to draw from the jury
box sixteen grand jurors, and thirty
After the opening of this townsite six petit jurors. Pursuant to this or
an agent of the Frederick Townsite | der the cleric of this court, the slier
company represented to the citizen* iff, and the county clerk, drew front
of Hazel that if they would move their
belongings from that town to Freder-
ick they would be given a clear deed
to the land upon which they would
move their property. They took the
agent's word and immediately aban-
doned their homes and took up their
residence in the newly platted city.
Lem Gosney, a former merchant of
the town of Hazel, but now of Freder-
ick, filed a suit against Lair to obtain
title to the land to which he moved
his stock of goods. The case will be
tried in the district court at Lawton
tomorrow on an appeal from Freder-
ick.
This is the second case of this char-
acter to come up at this term of court.
The other suit was brought by .1. E.
Prince, a hotel man, and the decision
of the court was against him. He
valued the lot at $1,200. The town-
site was originally the homestead of
Bob G isnell, and became the property
of Gosnell and John Stevens after the
townsite proof had been made.
This is the town at which President
Roosevelt and his party left the rail-
road to go into the big pasture to
chase wolves, and is one of the best
towns in Comanche county outside of
Lawton.

Johnson of St. Louis for the erection
the Jury box fifty-two names, the first
sixteen of which were summoned as
grand jurors, and the remaining thirty
six as petit jurors, and these jurors
were summoned by the United States
marshal for the district of Oklahoma,
and due return was made thereof on
the first day of this term of the court,
and in all respects as the statutes
of this territory direct.
On the reltirn being made motions
were filed by counsel representing
persons bound over for the commis
slim of offenses against the laws of
the United States and of the territory
challenging the array. A hearing
was had upon such motions, and the
poll books and other evideuce were in
traduced, showing that at the last gen
eral election this county was composed
of thirty-five election precinets, of
which thirty were old precincts, four
were newly created precincts, added to
the county by reason of the annexation
of the Haw Indian reservation, and
one precinct, Kaw City, was carved out
of Longwood township, thereby creat
ing two precincts out of the old pre
cinct as it was constituted in 1902.
It was further shown from the evi
dence that the county clerk had failed
or neglected to make any apportion
ment based upon the election of 1902
An attempt was made by the county
clerk to make an apportionment for
seven precincts, but an examination
of the poll books shows that none of
ihese were correctly made. It fur-
I ther appears that in the seven pre
cincts in which the county clerk at
tempted to make an apportionment
such apportionment was not com
plied with by the judges of election
In a number of precincts the Judges
of election failed to take the oath
required by the statute; and in several
precincts no names whatever were
drawn and returned by them; and in
number of precincts the judges of el
ection returned more names than the

construction is to be started as soon
as the site can be cleared of the one-
story brick buildings now located
there. It will be a handsome struc-
ture. The plans were drawn by Ar-
chitect C. L. Thompson.
Some Seasonable Advice.
It may he a piece of superfluous ad-
vice to urge people at this season of
the year to lay in a supply of Cham-
