ylug the legal effect of tho constitu-
tional convention's election (.unnance.
ami there Is u well-drawn contention
that the election Is called for that
date whether or no. It Is expected
the supreme court ln rendeilng n de-
cision In favor of tho convention next
week will have something to say re-
garding this feature of tho situation.
It is held by the students of the
situation that a proclamation of elec-
tion issued by a particular olllcer
within a distinct period of tlmo Is
merely Incidental to holding tho elec-
tion nnd not a necessity. It Is recited
that under any other constitution tho
authorized agent could arbitrarily re-
fuse to Issue a proclamation until It
was too late to net thereby defeating
thu purpose of tho authority ordering
thu election. This view Is partialis
held by territorial olllcers In Guthrie
although there Is buino question as to
when the constitution upon wnlch the
people nro to vote becomes n com-
pleted document when olllclally sign-
ed or when the convention drafting It
adjourns without day.
