The Jury in the csss of Sam Fite
this afternoon returned e verdict of
guilty sentencing the defendant to
term of five year for horse stealing
Sam has had an unsavory record this
being far from the first time for him
to be charged with offenses of the
character which will hold him for a
while' - Ills theft thla time was of a
team of horses belonging to Sam
Haynes -
i Following the Fife case the case
of George Mosely negro charged
with burglary of freight cars was
taken up and went to the jury
three this afternoon Mosely Is al-
leged to have broken into a car and
taken a quantity of tobacco two
large boxes
The case of Manuel - Hatsp the
young restaurant keeper w'ho Is
charged with attempt to destroy by
fire a competing restaurant in the
city some months ago was the” next
case called and Is on trial at press
hour
Royalty Cane Out of Court
During the forenoon Judge Hughes
suspended hearing of criminal cases
for a few minutes and took up a
motion which’ had bedta filed In a
case entered In Creek county relative
to "the ever recurring royalty segre-
gation on oil lease The Sapulpa Re-
fining company hasbought from the
guardian of Queen Victoria Jackson
the royalty production on the mtnor’a
very rich allotment In the Cushing
field '-The lessee the Kathleen OH
company refuses to segregate the
one-eighth from the working interest
production Suit was filed In &reek
county to compel the lessee to place
the royalty In separate tanks po that
the purchaser could take It in Its
line The defendant raised a Juris-
dictional point in its demurrer which
the court sustained it being shown
that the parties are resident in Tulsa
county It being a personal action
Jurisdiction of the cause Is In the

lessee company held responsible for
the price of oil sold from land owned
by him to the Webster Oil company
which he since the sale become a
bankrupt tHe seta up that the de-
fendant company aold the oil to the
refining company without bis consent
or agreement he having one-eighth
interest io the oil delivered to the re-
finery The defendant answers that
the lessor is bound by Ills lease to
look to the pipe line for pay for his
eighth that the lease agrees to de-
liver the onee-Ighth royalty to de-
fendant “In the pipe line" to which
the working Interest production la
delivered The point whether deliv-
ery to a refinery which has not the
public character of a pipe line as
generally known and whether such
delivery satisfies the terms of the
lease without an additional agree-
ment between the lessor and lessee
Is raised by the plaintiff It is hia
contention that not delivering the oil
to' a recognised public service pipe
line and delivering it to a private
concern impressed the delivery with
the character of a sale The run was
a sale In every delivery The refin-
ery was not a custodian of the oil
holding it as a pipe line for sale
later but a buyer of it at delivery
If then the buyer was not responsible
the seller must be This makes an
Interesting csbo which no doubt will
go to higher courts on appeal which-
ever way Judge Bosarth rules The
amount Involved is about $800 A
demurrer was filed in the case which
Judge Bosarth stated to attorneys he
would pass upon with consideration
of the main case Briefs will be sub-
mitted by Attorneys W M Matthews
and A A Davidson of TuTsa who
pear for the parties respectively
