The final discharge of the second
Kuhn jury marks the end of a most
remarkable episode It would takes
page after page of a newspaper to
bill all that has transpired in this
ease— on the surface and possible a
great deal has happened in a private
sort of Way the nature of which the
public does not and cannot know
The legal presumption is that a
man it innocent until he be proven
guilty The absolute failure of the
state to prove Kuhn guilty should
militate in his favor Be it remem-
bered that Kuhn is not required to
prove his innocence — he is mb rely to
await the efforts of the state to prove
him guilty Those efforts took the
form first of a court of inquiry
which functions very much as a grand
Jury Kuhn was not permitted to
know what was shaped up against
him nor was he permitted to know
who the witnesses were The force
that were arrayed against the sheriff
were somewhat heavy and the victim
was compelled to act on the defensive j

hung jury

Kuhn was merely a sort of drift-
wood floating on a current of official

COUNCIL QUIT
FIGHT ON KLAN

CHICAGO Oct 18— The national
unity council formed to combat the
Ku Klux Klan has abandoned Its
plans for a national organization
according to a letter sent yesteraay
by former Governor Edward F Dun-
ne The council will instead substitu-
te a plan for a general committee to
foster kindlier feelings between all
classes of Americans and the elimi-
nation of racial and religious anomo-
sities WASHINGTON Oct 18— The
proposed investigation of the Ku
Klux Klan by congress blew up yes-
terday After a ten-minute session behind
closed doors the house rules com-
mittee which at morning and after-
noon sessions cut William J Sim-
mons the Klan’s imperial wizard
through a rigid examination voted
unanimously not to call any more
witnesses at this time'
Announcement of this action was
made by Chairman Campbell and
while the chairman and members re-
fused later to comment beyond the
bare statement as to witnesses it 1s
expected that an adverse report will
be submitted to the house on a num-
ber of resolutions providing for such
an Investigation ‘
Final action however will not oe
taken until several absent members
accepted it as settled thst they were
done with the Ku Klux Klan unless
the department of justice conducting
an inquiry of its own comes forward
with unexpected evidence
