- BUYERS OF MALT
' ENNEARTENED
COURT RULING
- -
Andrews gets ets Forth Con-
ditions Regarding Its Manu
facture ' -
Citizens and merchants who re-
untly were discouraged by an an-
nouncement in Wake SuperiorCourt
by Judge A M Stack to the effect
zhat railroads that haul malt are in-
dictable and that sale of malt is a
violation of the Volstead lay took
heart when rulings on the subject by
General Lincoln C Andrews Federal
Administrator of ProhiblitejA were
dug up in which the assistant Secre-
cary of thlt Treasury had issued corn-
xehensive instructions after a con-
:erence with the manufacturers of
malt setting forth the conditions un-
Ier which it might be manufactured
Ind said
The essence of the ruling made by
he Federal' administrator is that
:here malt is sold with labels and
araphernalia indicative of the fact
hat it is to be used for making
beer in violation of the law" it is an
flense hut that "there are many in-
laArial uses for malt syrup in large
luantities and many domestic uses
or malt syrup in small quantities"
In Circular No 128 issued FebruIn-
In 1927 to all administrators
3enci4l Andrews takes the position
Int the supplying of this legitimate
!emend for malt can not be construed
ts a violation of the Volstead Act He
ludged tile sales about however with
t lobs arrived at after a lengthy
-)rfcrenee with manufactures who
1f2300(1 to assist in shutting off "wild
at beer operators" and to promote
tiniate trade
Ilere are the rulings which General
'THE C1131tINO''DAILY- CITIZEN--
Aadrivra approved for the guidance
of wholosahne of malt Syrups:
(1) Waste and dvert4itig7 shall
contain no language that in any man-
ner refers to beverages or indicates
that the product may be used in the
manufacture of a prohibited beverage
(2) AU trade names used in con-
nection with the salq of intoxicating
beverages must be eliminated also
all names including the word "brew"
or which convey the idea that the
project is intended for brewing pur-
poses and all pictures of steins mugs
brewery and brewery equipment
(3) AU warnings appearing- on
labels or in advertising wherein the
purchaser is warned against the use
of the product in the manufacture of
an intoxicating beverage must b?
stricken therefrom
General Andrews made it plain quit
what he wanted to stop was the sup-
plying of malt to "alley and wildcat
breweries" who "depend larg-ely upon
wort 'br malt syrup for their manu-
facture of beer" He said that he had
the assurance of co-operation from
the manufacturers in stopping this
"wild cat"- business and suggKted
that the sale of malt for legitimate
trade could not be stopped
R Q Merrick State Prohibition Di-
rector sometime ago issued through
the Charlotte Observer a ruling to the
effect that there is no legal way of
stopping merchants from selling malt
