TAXES IN PAYMENT OF THE COST OF CONSTRUCTION OF A SAN-
ITARY SEWER IN SEWER DISTRICT Na 126 IN THE CITY OF
ENID OKLAHOMA AS CREATED AND ESTABLISHED BY ORDINANCE
DULY PASSED AND APPROVED BY TIIE MAYOR AND COMMISSION-
ERS OF THE CITY OF ENID OKLAHOMA AND DECLARING AN
EMERGENCY -
WHEREAS in pursuance to the provisions of the Ordinance duly passed
and approved by the Mayor and Commissioners of the City of Enid Oklaho-
ma and the Statutes of the State of Oklahoma for such cases made and
provided the said City of Ecid Oklahoma did by Ordinance duly passed and
approved by the Mayor and Commissioners of the said City of Enid Oklaho-
ma create and establish Sewer District No 126 and after having declared
It necessary to construct a Sanitary Sewer in said Sewer District by the
yin:Malone of said Ordinance did on the 7th day of June1926 let to Earl
W Baker & Co a certain contract for the cunstruction of a sanitary sewer
in said Sewer District No 126 and:
WHEREAS in pursuance to said contract the said Earl W Baker &
Co has constructed the certain sanitary sewer in said Sewer District and
the work under the said contract has been completed and accepted and ap-
proved by the Csty Engineer and the Mayor and Commissioners of the City
of Enid Oklahoma and:
WHEREAS in further pursuance of the laws of the State of Oklahoma
as aforesaid and under Ordinances of the City of Enid Oklahoma it is deemed
necessary by the Mayor and Commissioners of the said City of Enid Okla-
homa to levy and assess a special tax npon the property liable to assessment
in said Sewer District No 126 by reason of the construction of said Sewer
to pay the cost of tIle said improvement and
WHEREAS the total cost of the construction of said Sewer in Sewer
District No 126 includng all extras have been ascertained and is hereby de
dared to be the sum of 378965 all of which is to be levied by special assess-
ment against the lots and tracts of land benefitted by theiconstruction of
said sanitary sewer in said Sewer District No 126
WHEREAS all legal requirements have been complied with to authork'e
the levy of the assessments against the said Iota and tracts of land liable f ir
the cost of the construction of said sewer in said Sewer District No 126 r
the amounts hereinafter specified and set opposite each description of tat d
liable to assessment in Section 1 hereof
NOW THEREFORE BE IT ORDAINED BY THE MAYOR AND COM-
MISSIONERS OF THE CITY OF ENID GARFIELD COUNTY STATE 01
OKLAHOMA
Section 1—That there shall be and hereby is levied apportioned and as-
awed against the several lots and tracts of land in Sewer District No 126
in said City of Enid Oklahoma so henefitted by construction of said sew-
er the amount respectively set forth as follows to-wits'

section 2-That the assessment hereby levied on each of the above men-

Section 3-That al assessments hereby levied shall be eivided into three
equal annual installments as authorized by the laws of the State of Oklahoma
for strh cases made and provided and the assessments shall bear interest at
the rate of 8 per cent per annum payable annually at the time of the pay
ment of the several netallments of assessments from the elute of the taking
effect of this ordinance that the first installment of said assessments to-
gether with the accrued isterest on the deferred installments shall be payable
on the 15th day of Deetember 1926 and the temaining deferred installments
shall be payable on the 15th day of December of each succeeding year until
all shall be paid provided however that any owner of the lots and tracts of
land tee asetssed may at any time during the four weeks fei2owing the date
of the trst publication of this ordnance pay to the City Clerk: the full amount
of the assessment levidI agaisst the said Into and tracts of lund and thereby
release such property from the lien of such assessments
Section 4-That this ordinance shall be published for fear eonsecutive
weeks in the Enid Daily Times a newspaper-published in Enid: Oklahoma and
that the publication of this ordinance as required by law Wall be taken and
regarded as sufficient notice te all parties interested in the aseessments here-
by levied by the tenses of this ordinance
Section 5-That art ordinances or partsill ordinances in vonflict with the
provisions of this ordintinet in so faras stall conflicti f'xist are hereby repealed-

and the Statutes of the State of Oklahoma for such cases made and provided

and establish Sewer District No 125 and after having declared it neceseary
to construct a Sanitary Sewer in said Sewer District by the provisions of said
ordinance did on the Ith day of June 1926 let to Earl W Baker & Co ft
certain contract for the construction of a sanitary seleer in said Sewer Dis-
trict No 125 and
WHEREAS in pursuance to said contract the said Earl W Baker &
ICA halt constructed the certain sanitary sewer in said Sewer District andj
11 the work under the said contract has been completed and accepted and ap-
proved by the City Engineer and the Mayor and Commissioners of the City
of Enid Oklahoma Old
WHEREAS in further pursuance of the laws of the State of Oklahoma

said Sewer and to pay the cost of said improvement and

to be the sum of $114877 all of which is to be levied by special assessment
against the lots and tracts of land benefitted by the construction of said sani
tary Newer in said Sewer District No1'25

the cost of the construction of said sewer in said Sewer District No 125 in
the amounts herein specified and set opposite each description of land liable

be payable on the T5th day of December each succeeding year until all shall
be paid provided however that any owner of the lots and tracts of land so
assessed may at any time during the four weeks following the date of the
first publication of this ordinance pay to the City Clerk the full amount of
the assessment levied against the said lots and tracts of land and thereby re-
lease such property from the lien of such assessments

weeks in the Enid Daily Times a newspaper published in Enid Oklahoma
and that the publication of this ordinance as required by law shall be taken
and regarded as sufficient notice to all parties interested in the assessments

Section 5—That all ordinances or parts of ordinances in conflict with the
provisions of this ordinence in so far as such conflict exists are hereby re-
pealed Section 6 By reason of the fact that the City of Enid Oklahoma has
obligated itself to issue Special Tax Warrants in payment of the cost of
the improvement and delay thereof might cause litigation and expense
therefore an emergency is hereby declared to exist to preserve the public
Peace health and safety so that this ordinance shall take effect and be in
torce from and after its passage approval and publication
