Lines Tightening
The lines of the two sides in the
supreme court proposition seem to
he slowly but surely tightening as
the day of the great battle draws
near and there seems to be no in-
tention of quitting the fight by
leaders on either side
The announcement that Justice I
Van Devanter has resigned to take
effect early in June has set the po-
litical tongues and observers in
Washington and elsewhere to wag-
ging fiercely and it is wondered
now just what effect this action I
will have on President Roosevelt's
suggestion for a change
Does it mean as some think that
some of the justices actually seel
he "handwriting on the wall" and
Van Devanter has taken advantage
of it and really has beaten the
president to it?
Or does it mean that the justioe
has grown tired of the controversy
and is quitting to get out of it?
Or is it a fact that be just does
no' care to continue to serve on the
bench when there is criticism by
the president of some of his legal
opinions?
There Might be any number of
reasons for the resignation and
any of them might be sufficient to
cause his resignation
But what result will it have
the fight for the changes as pi o-
posed by President Roosevelt?
The battle when it really starts
is going to be one of the most mo-
mentous on questions of this kind
ever taken before congress and
the entire world will watch the re-
sult with bated breath
There will be criticism and com-
mendation from all sides and no
matter which way it goes there will
Le some to condemn

Robinson Mentioned
WASHINGTON' May 19--(1P)—
Senatorial colleagues pushed the
name of Senator Robinson Domo
crat Arkansas to the forefront of
the discussion today of possible
successors to Justice Willis Van
Deventer
Senator Pittman Democrat of
Nevada publicly voiced the view
expressed privately by many other
Democratic senators that Robin-
son 64-year-old party leader
should be appointed
"In 30-odd years in congress he
has proven he is a man of integ
rity and courage and splendid le
gal attainments" said Pittman
Eligibility Disputed
A dispute arose over Robinson's
eligibility Some senators held the
view that the recent enactment of
the Sumner s retirement bill barred
the app(Antinent of any present
member of congress
The Sumners bill provided full
retirement pay of $20000 a year
for supreme court justices The
constitution prohibits the appoint-
ment of members to congress to
posts created during their terms
or the "emoluments" of which have
been increased during their terms
