Ballot Dispute
(Okahoman Times Norman Bureau’
NORMAN - A legal decision ap-
parently has killed chances of a
iniversity of Oklahoma student
body referndum vote on accept-
ance by the OU student senate of
recent senate and senior class elec-
tion returns
A referendum petition, contain-
ing 156 signatures was presented
Tuesday to the student senate pres-
ident. Garla Braithwaite. Enid It
asked for a student body vote on
Te senates decision because ol six
alleged irregularities in the elec-
tion
A senate investigating committee
had probed the alleged irregulari-
ties for 5 hours, after which the
senate debated 412 hours before
voting, 17 12 to accept the election
returns
Proof Not Sufficient
They could not find sufficient
proof of any discrepancy strong
enough to invalidate the entire
election
Braithwaite referred the petition
to Dr Frank Elkouri. legal ad-
visor to President George Cross,
for an opinion upon the legality
of the petition
Dr. Elkouri ruled he could find
no valid basis under the present
constitution for the petition He
said a section of the student con-
stitution made it the sole judge
of its membership while another al-
lowed for the referendum
Precedence Rules
Since the two were in conflict.
Dr Elkouri said precedence dic-
tated the conflict should be aboid-
ed and the sole-judge provision
would apply
Earlier. Braithwaite told news,
men the senate would follow the
legal advice in deciding the issue

425 NE Park, of the chain beating
Robert L Hert, district judge as-
signed here from Stillwater, said
he would pass formal sentence
next Tuesday
Tacker was convicted of hitting
Jerry Oscar Bieser, 23. of 1509 N
Phillips, with the length of chain
outside a tavern in the 3000 block
Paseo. The incident occurred after
another fight inside 'the tavern.
Tacker also was involved in t h e
first fight and hit two amputees
with his fist
The youth did not take the stand
in his own defense in district court
trial A companion testified he
heard someone say, "Let's get
him," before Tacker pulled the
chain from his pocket.
The prosecutor, Max Lawrence,
assistant county attorney, pleaded
with the jury to send Tacker to the
penitentiary. He charged Tacker
was looking for a fight" or he
would not have been carrying the
chain
jurors, however, took just over
an hour to find Tacker guilty and
fix the penalty at 6 months in jail.
