What is the Truth in the Mc-
Namaxa Case?
The McNamara case threatens to
'become the occasion of an acute
struggle betwehn capital andlobor-
When the head of the Structural
Uron Workers Union was arrested
the evidence against him appeared
'to be strong A series of crimes
seemed to point to the directing
head and to involve this union
However the speed with which
which McNamara wa rushed out of
Indiana and the early appearance of
Harry Orchasd duplicate raised an
element of doubt until thecasecan
be hoard in- full
In the meantime the labor load-
ers have maintained that the evi-
dence against McNamara is manu-
factured that dynamite-was plant-
ed to cast suspicion on the union
leaders and that crimes have been
committed by conspirators who are
determined to work the destruction
of the union
The Appeal to Reason proceed-
ing upon the theory that to find
the man vho blew up the Los An-
geles Times building is the surest
way to clear McNamara sent a
staff of representative to Los An-
geles to soatch for evidence
This man worked or weeks and
twenty-four hours after he wrote
his employer and members of his
family that he had secured evi-
dence to justify the indictment of
Otis and Tom Ricco a half-breed
Mexican in his employ he disap-
peared His battered hat and a
piece of hose filled with lead found
at the same spot furnish the only
clue as to what has become of him
When his disappearance was re-
po ted to the Los Angeles police a
detective who had helped work up
the case against McNamara was
assigned to the investigation He
searched th' missing man's room
and appropriated or destroyed all
his priviate papers The manu-
scripts of the story known to have
beer' prepared is also missing
A reward of $500 has been of-
fered for evidence as to the where-
abouts of the man or evidence that

It is also charged that Otis ac-
cepted a bribe to support Calhoun
in the San Francisco graft scandal
He was denounced by Heney and
and a few days later Heney was
shot in open court Heney’s as-
sailant was shot by the chief of
police of San Francisco who was
murdered by being thrown from a
police launch and drowned It is
charged that Ricco was responsi-
ble for his death and that Ricco
was in the employ of Otis
The disappearance of this man
makes an ugly situation It lends
color to the charge that a conspir-
acy exists to discrepit and destroy
the union
If Otis and those who have been
allied with him in the fight on or-
ganized labor have actually com
mitted the crime charged to the
labor leaders as the instrument of
a conspiracy to kill the union they
are guilty of crimes without par-
allel They are worse than Mc-
Namara and his associates would
be if they were guilty
Every man is entitled to a fair
trial Neither Otis nor McNamara
should be condemned bv newspa
per reporters But if Otis is not
guilty of the foul conspiracy charg
ed he is guilty of publishing the
foulest newspaper printed in the
English ' language No Ilearst
newspaper at worst ever approach-
ed the Otis sheet as a scandal mon
ger and A nurveyor of all manner
of filth If the character of Gen
eral Otis js reflected in his news-
paper it is not hard to believe him
capable of almost anything that
may be charged against him
The Amerjcan people are in the
main fair minded and just If a
conspiracy on the Dart of Otis and
others can be established no dow-
er can raili cad the labor leaders or
save th3 gui lty If the McNamaras
are guilty no appeal to passion or

'Frst Time in $0 Years Maine
is Voted Dry
Portland Me Sept 11 — The
state of Maine having 50 years ago
adopted in her constitution an arti-
cle of state wide prohibition has
just witnessed one of the most bit-
terly fought and strpnuous cam-
paigns ever known to New England
120000 citizens going to the polls
to vote on the question of whether
or not intoxicants can be' sold in
this state Both sides in the fight
have been extremely active and
the state has been flooded with
campaign literature Meeting for
and against state-wide prohibition
have been held in every city town
and village in this state 1
Out of the 120000 voters who
cast their-ballots hi the election
today— so far as counted at 1 1 :30
Monday night — the count showed a
majority of 1400 for the repeal of
the prohibition clause
At 1:30 Tuesday morning there
were 25 small towns and outlaying
districts to hear from all of which
at the last election gave a majority
in favor of a repeal of the amend-
menc There was absolutely no excite-
ment over tho election— every
voter having made up his mind be-
fore the election day rolled around
— and determination was written
on every face
Out of the outlaying rural pre-
cincts in this state the last elec-
tion the advocates of the repeal of
the amendment to the state consti-
tution— (or “the wets”)— secured
804 majority
The press of the state was divid-
ed upon the question and each side
devoted colums of arguments and
attacks Speakers of both parties
presented their respective sides to
the thousands of attentive listeners
and even women and children were
drawn iijto the agitation by the
prohibition element
Constitutional prohibition in
which Maine was the pioneer was
first adopted in 1 884 In 1901a
bill for the resubmission of of the
subject was before the legislature
but was defeated In 190? a sim-
ilar proposition was again defeated
but only by a narrow margin But
at the last election a Democratic
governor and a Democratic legis-
lature were elected and resubmis-
sion was voted which resulted in a
victory for the wets
LATER
Portland Me Sept 13— Official
returns up to midnight indicate
that the State of Maine will remain
in the ’‘dry’’ column at the head
of which she has stood for fifty
years The dry majority wilt be
about 150
Throughout the day yesterday
the indications were that the State
went wet by about 175 and aeon-
test of the election was imminet
However later returns changed
the result which is so close that
the wetB will in all probability file
a contest "
