OLD-AGE PENSIONS COMING
The transition from independ-
ence to dependence seems inevi-
table for a large part of the pop-
ulation Most men and women
approaching 70 face a real prob-
lem Many of them are trained
for occupations which no longer
exist and of course their adapti-
bility has decreased Both men
and women ' become burdens on
their children They are ail faced
with a haunting fear of want dur-
ing the twilight of their lives
Economists statisticians and rep-
resentatives of charitable and re-
lief agencies insist that the old
age pension is the only method of
dealing with the problem and fra-
ternal organizations all over the
nation are backing the movement
Ten American states and Alas-
ka already have adopted old-age
pension laws based largely on
plans existing in seven Canadian
provinces and New York is con-
sidering a similar proposition
Manufacturers are generally op-
posed to the plan because it may
increase their taxes but manu-
facturers generally manage to pass
these items of expense to ultimate
consumers In any event old peo-
ple must live and society must
pay the bill Its only a question of
how that expense shall be distri-
buted The British foreign Secretary
says that while the League of Na-
tions has cost the nations compos-
ing it about the expense of one
first-class battleship it has been
the means of averting seven possi-
ble wars
DISAGREE WITH JUDGE RICE
Blackwell Tribune:
Three temporary injunctions
have been granted recently in the
district court of Kay county re-
straining the county attorney the
sheriff all deputy sheriffs and all
police officers of the county from
interfering with the operation of
certain slot machines or so -called
vending machines The editor of
the Tribune finds himself unable
to agree with or approve the
course of Judge Rice by whom the
injunctions were granted
In our opinion based upon our
understanding of the law and the
nature of the machines the slot
or vending machines are gambling
devices and are so generally re-
garded by the public Why should
a district judge grant temporary
injunctions restraining the county
attorney the sheriff and all dep-
uty sheriffs and all police offi-
cers from interfering with their
operation? ’We believe that the
machines are operated in violation
of the law On technical grounds

What Others Say
We believe that a judge should
grant such temporary injunctions
only after all the facts have been
presented to hiin and it has been
shown that officers are clearly
violating the law and that a great
wrong will be done if they are
not restrained No such condi-
tions exist in the cases referred
to here If any injunctions were
granted at all in these cases they
should have been directed against
the owners and operators of the
slot machines not against the of-
ficers It appears to us that the
officers are restrained frqm doing
their duty as required by law It
appears to us as the matter now
stands that the restraining orders
permit gambling devices to oper-
ate in defiance of law and forbid
officers to interfere with such
operation
One thing is certain : Either the
law is wrong 6r Judge Rice is
wrong Just now our opinion is
that it is not the law that is
wrong Should these cases reach
the supreme court that body may
not agree with our interpretation
of the law In event the higher
courts holds the law is wrong or
weak or lacks clarity it should
be corrected so as to make the
suppression of gambling devices
not only possible but easy But
even should the court hold techni-
cally that gambling devices
should be permitted to operate at
this time that would not in our
opinion excuse a judge for order-
ing officers to leave them alone
The proper method of testing out
a law of this kind is not by in-
junction but by bringing violators
into court and trying the matter
out by due process and procedure
BORGER EXTREME EXAMPLE

plain It is analogous to the dis-
orders that marked many border
towns of the West in their making
Mushroom growth does not make
for stability Not only do many
who form such communities re-
vert to baser inclinations where
there is not normal restraint but
there are those who flock to such
places because of what they are
Borger now is a place of 20000
inhabitants but its disreputable
character was formed before it
had any form of government
when there was a rush for a new
oil center with a rich by-product
of black carbon Twice before
Texas rangers went in to establish
order and set up a controlling
government The pressure of vice
and gambling has been too much
for those put in power The con-
trol sought for was not forthcom-
ing At least some of the re-
sponsible officials have been ben-
eficiaries of the very conditions
they were expected to correct
Now that vice and crime have
made the town a reproach to
Texas and to the whole country
there is outcry against the public-
ity given and the interference of
Governor Moody No doubt it is
true that the turn of events is
“hurting business” in Borger but
the only business that is complain-
ing is illegitimate business the
business of vice and gambling and
bootlegging and the business of
graft incident to it Legitimate
business never fears law and or-
der The story of Borger is not a
common story these days yet it
has its relation to lawlessness and
crime wherever they burden a
city If public officials are not
honest if they are not competent
they contenance crime for
political reasons or still worse
for a share in the profits the city
suffers Even in the most stable
cities these evils cannot be kept
down to the minimum except by
honest efficient and aggressive
public officials
