Barrett said he expects the

we wouldn’t have included them
in it in the first place.”

“1 expect that from my conver-
sations with his (Juergens’) attor-
ney, that he doesn’t care if they
stay in (the lawsuit) or not,” Bar-
In addition, Haas said the de-
mand petition filed in April is ob-
solete because the declaratory
judgment will determine the legal-
ity of the paycheck.
Attorney Mark Barrett, attor-
ney for the 10 defendants, said
the motion to dismiss was filed
because his clients are not the
proper people to be sued in this
matter.

Ten persons were released as
defendants Monday from a de-
claratory judgment lawsuit
sought by former city employee
Doug Juergens, his attorney said
Monday.
Juergens, former city attorney,
filed the lawsuit April 23 in Cleve-
land County District Court
against the city and 12 individuals
to determine the legality of his
last paycheck from the city.
A motion to dismiss the law-
suit, filed by the 10 defendants,
was passed by agreement Monday
at a hearing in Cleveland County
Court House.
Juergens named 12 people in
the lawsuit who filed a demand
petition April 9 to direct the city
council to recover funds from
Juergens’ disputed paycheck.
Norman Attorney Del Bauman
and Daphne Hudson did not seek
dismissal of the lawsuit.
Norman Attorney Fielding
Haas, who represents Juergens,
said the result of the dismissal of
these defendants from the lawsuit
will be an agreement that they
refrain from filing more demands
against Juergens’ paycheck.
Barrett said the motion was
passed by agreement to allow an
arrangement to be worked out be-
tween Juergens and Barrett's
clients.
Ten persons released from Juergens’ lawsuit
abstain from filing a taxpayers’
lawsuit against Juergens.
Barrett said he would not re-
lease other details of the agree-
ment until he has completed fur-
