Wherous, it was heretofore declar-
ed by the Mayor and Councilman of
tha City of Claremore, Oklahoma,
that the sewer was necessary in Sew-
er District No. 17, in said City of
Claremore; and
Whereas, after due notice, the con-
tract for tyiilding and constructing
Mid Sewer District Wan awarded to
Owings Shofner & Co.; and
Whereas, the said Owings Shofner
A Co. has fully performed and com-
plied with said contract and construc-
ted said District Sewer; and
Whereas, the Engineer has made

the amount named in this Ordinance,
together with the prorated amount of
publication fee, shall not be paid, then j
the City Clerk is hereby directed and
ordered to issue tax warrants against i
each such lot or piece of ground in
said district, which said tax warrant
shall recite the date of the passage of
this Ordinance, the amount of assess-
ment, the description of the property
against which the same is levied, art
that the same will be levied again
said property in three equal insta
ments, with interest thereon at ti.
rate of eight per cent per annum,
levied each year, which shall become
due on the 15th day of December next
after each levy.
Section 3. That tha Clerk of sa i
City shall deliver to the contractor
an aggregate amount of such war
rants not to exceed his contract prict
and the Clerk shall hold and retain
for the City's indemnity a sufficient
amount of such tax warrants to cover
all other expenses than the contract
price for the construction of such
work.
