Kirkpatrick is defendant command-
ing me to levy upon property be-
longing to the said J N Klrkpat
rick sufficient to satisfy a judgment
rendered in said action in favor
of the said plaintiff for the
principal sum of $141400 and
$13925 attorneys fees' and $6350
interest and all costs in this ac-
tion as well as the costs in cause
number 1925 I have levied upon
the following described real ‘ estate
situated in said Love county Okla
homa the record title of same be-
ing in Kate Culwell but the equit-
able title to same being in the de
fendant J N Kirkpatrick and- the
same having been impressed with a
lien by said district court for the
payment of the above indebtedness
subject to a certajn judgment debt
of about $343600 with interest at
10 per cent per annum from Feb-
ruary 27 1923i rendered in said
district court wherein W H Swan

et al were defendants and the
taxes on said land amounting to
about $ towit:
The nwl-4 of nwl-4 and wl-2 of
nel-4 of nwl-4 less 4 acres for
school site in the extreme northeast
corner of the nwl-4 of nel-4 of
nwl-4 being 56 acres in section 34
township 7 south range 1 west
The wl-2 of swl-4 and sl-2 of
sel-4 of swl-4 being 100 acres in
sectioq 27 township 7 south range
1 west
Ail of above land being in Love
county Oklahoma Also lot five
(5) in block nineteen (19) in the
city of Marietta Oklahoma
That said land is not exempt form
sale under execution and that
have caused the same to be appraised
at $596000 subject to the said W
H Swan judgment of $343600 now
owned by the First National Bank
Oklahoma City Oklahoma
Now therefore notice is hereby
given that I will in pursuance of
said execution offer for sale and
sell for cash to the highest bidder
said lands and tenements subject to
the judgment debt of the First Na-
tional Bank Oklahoma City Okla-
homa and the taxes or so much
thereof as will satisfy said judg
ment and costs on the 6th day of
June 1923 at 1:30 o’clock in the
afternoon of said day at the east
front door of the eourt house in the
city of Marietta Oklahoma

Effective last Sunday the time of
trains No 11 and 12 changed time
and train No 1 1 now ' arrives in
Marietta at 12:41 instead of 12:59
as formerly and train No 12 arrives
in Marietta at 8:07 instead of 2:32
as formerly Train No 11 is the
south bound train and No 12 is the
north bound train The change in
time of these two trains make it
convenient for persons who want to
make hurry-up trips to either Ard-
more or Gainesville a' you can go
either place and back in the same
afternoon now - Formerly you could
go to Ardmore on No 12 and get
back to Marietta on 17 and you can
still make the trip and have over an
hour in Ardmore Before the trains
changed you could not make a trip
to Gainesville and back in the same
afternoon but now you can leave
Marietta on No 11 and return on
No 12 and have about an hour in
Gainesville Both of these trains
are fast trains and the time between
Galveston and Kansas City on No
12 has been shortened about three
hours

Roy Yarrington was in the Hardy
sanitarium two or three days the
first of the week as a result ' of an
operation which he underwent in
having his tonsiia removed
Ardmore May 14 — Lawrence Pol-
lock 38 years old son of State Rep-
resentative Thos J Pollock of Ard-
more was almost instantly killed in
the Graham field early Monday
morning when he was struck by a
bolt of lightning during a heavy
rain storm which visited the district
The young man fell a victim to the
death-dealing streak as he was walk-
ing across the Cameron Refining
Company’s lease in the southeast
quarter of section 80-2s-2w 'Ha was
in the midst of three derricks and
a battery of tanks at the time but
the lightning missdd all the proper-
ty striking only its human target
Mr Pollock is survived by his
wife and a daughter He was a res-
ident of Graham for several years
and was popularly known through-
out this section of the state At the
time of his death he was in the em-
ploy of M T Smith drilling contrac-
tor as a driller
The storm which visited the
Graham territory Monday morning
was one of the worst which the
residents of that area have yet ex-
perienced A light rain fell Sunday
night and streaks of lightning made
their appearance during the early
hours Monday morning About 5
a m the storm broke into a fury
when a strong wind swept down
from the north transforming the
rain into an incessant series of
sheets of water which continued for
a period of forty minutes during
which the residents of the town
rushed into their storm cellars
Light rain followed the wind and
rain storm until about 11 o’clock
when the clouds traveled south and
the skies ' above Graham '-cleared
Ideal weather was reported in the
district at noon
The heavy rain arrived in Ard-
more about noon and lasted for n
period of 'fifteen minutes
No damage to property was re-
ported from the Graham district ac-
cording to all available information
The storm played havoc with tele-
phones wires resulting in indistinct
connection
