propositions received a majority of
the votes cast, but not the two-thirds
vote required by law. and are there-
fore defeated.

Flops to the Democrats.
Guthrie, Okla., April 3 —Tbe Dem-
ocrats are celebrating a victory to-
night. Only one Republican, Walker
in tbe First ward, Is elected. The
city council will be strongly Demo-
cratic. The school board has a Re-
publican majority.
Mayor Duke, elected last year, la a
Democrat.
This Is tbe greatest defeat for the
Republicans In tbe history of Guth-
rie. Tbe recent gerrymandering of
the wards by a Republican council
for the purpoa: of ellminat ng ne-
groes from ofttce-hoMlng, la largely
responsible for tbe result.

Washington, April 3.—Argument
was begun today in the supreme
court in the case of the United States
against United States Senator Burton
of Kansas. Tbe government wait rep
resented by Assistant Attorney Gen
eral Charles H Robb and Mr. Burton
by a long array of counsel conaisting
of Ex-Judge John F. Dillon, Balle P
Waggoner, Henry Hubbard, W. H
Rosslugton, W. Knox Hiynes, F. L.
Lehman and W. P. Hackney.
The charge againat Senator Burton
in this caae is the aame as that pre
ferred when tbe case waa before tbe
court laat year except that in this
case the receipt of money by Burton
in St. Louis is alleged. Tbe reversal
of the decision of tbe court on the
former appeal wa« based upon the
failure to show that fact, the testi
roony a then edduced only showing
that be was paid for bis services with
checks which were cashed in thia
city. Tbe charge against Burton 1
that of violation of section 1*72 of
the revised statutes, prohibiting sen
ators and members of tbe house re
ceiving compensation for services
rendered in relation to any proceeding
in which the United States ia inter
ested.
Burton is charged with accepting a
fee of 9500 a month from tbe Rtaito
Grain and Securities company of St.
Louis for repreaent'.ng that company
before tbe postofflce department in a
proceeding charging that company
witb fraudulent use of the mail.

defense was summed up in tbe follow-
ing language:
"We maintain first, that tbe prea-
ent indictment does not state a case
in which the United Slates is 'inter-
ested'within tbe meaning of section
1782. and, second, even tbat interest-
ed nevertheless, tbe proof shows tbat
Burton neltber agreed to render nor
did render any servicea In respect ot
any matter In which in any view the
United Statea had any intereat, direct
or Indirect."
