guilty and sentenced to six months

sentenced to twelve years in the
penitentiary
Grading for Railroad
Grading of the Missouri Oklaho-
am & Gulf railroad through Bryan
county will be begun during this
month and the steel laying will be
under way by the latter part of
the month The right of way
through tue city will he secured at
the next meeting of the council

the road south of Calvin have been

Subpoenas for Jurymen
It became known at Muskogee
Sunday that subpoenas had been is-
sued summoning six members of
the Feedral grand jury which indict-
ed Gov Haskell and six Muskogee
citizens on charges of conspiracy to
defraud in the Muskogee townslte
case to appear at Tulsa tomorrow
morning When the case will come
up In the United States court The
names of those summoned could
not be obtained It Is stated a sen-
sation wl be sprung that the de-
fendants will try to show these
emmbers of the Jury were Intimi-
dated by Col Rush and other gov-
ernment officials during the inves-
tigation of February
1741 In Attendance
The report of the secretary of the
local Railroad Y M C A of Sa-
pulpa the only one in the state is
interesting from the fact that Sapul-
pa is placed second to one of " the
largest cities in the West and goes
ahead of such' places as Kansas
City Monett Fort Scott and others
of equal size and importance The
attendance for the month past
shows 1741 for St Louts and 594
for Sapulpa while Monett the next
has 485
Case Appealed
The case of the Oklahoma Na-
tions! bank vs the First National
bank of Shawnee has been appealed
to the supreme court According to
the petition In the case the First
National became insolvent on Jan-
uary 10 1906 and made an agree-
ment with the Oklahoma National
to liquidate Its affairs The latter
bank agreed to pay off the depos-
itors of the insolvent bank and en-
deavored to realize on its assets
but was unable to get enough out
of them to break even and brought
suit against the First National for
$43240154 obtaining judgment for
$2802924

The state board of normal school

Representative Henry Ireton Is the
proud possessor of the pen with
which Gov Haskell signed the Chlck-
asha school bill and he also has
the pen which Clerk Miller used
In enrolling the bill
He Is going to have both pens
suitably framed and when the main
college building Is erected they will
grace its wails In a conspicuous
place
Mr Ireton was promised the pen
by the governor before th elegisla-
ture adjourned but to make sure of
getting it and also to be present
at the signing he went to Guthrie
last Friday returning with his pre-

Rev Moore of SL Louis who
filled the pulpit at the Christian
Church at Chlckasha Sunday has
been selected by the official board as
the new pastor of the Christian

Death of John McGrain
John McGrain aged 78 a native
of Ireland died at Stillwater Sunday
For thirteen years he drove an ox
team across the plains to Califor-
nia and later hunted gold in Aus-
tralia New Zealand and Africa Al-
though 65 years old he Joined the
rush to Alaska and dragged a sled
1300 miles In winter He left no
relatives but an adopted son

Broom Factory Burns
The Lacy Broom Factory located
at the corner of Fourteenth street
and Florida avenue Chlckasha
burned Friday night about 11
o'clock The building was a total
loss Tbe cause of the blaze was
not ascertained There was no
mains In that vicinity and the
flames were beyond control of the
firemen The loss is estimated at
$1000 Tbe fireboys from the sub-
station made the run to the fire

returned Sunday morning from New

of the twelve delegates from the

ed a full pardon to J T Phillips
who was sentenced to one year In

versed and remanded the case in
which G W Green was convicted at
Atoka of killing Martin Listln in

Green took a change of venue from
Bryan county to Atoka The opinion
was banded down by A C Cnee
special judge sitting in the plaoe of
Chief Justice Furman who was
disqualified to hear the case Green
claimed self-defense but the instruc-
tions of tbe Judge in the lower court
practically eliminated this contention

the trim vessel that sailed from this
port two years ago returned Saturday
Making her way slowly into the har-
bor with pumps working the Bona-
venture presented a picture that told
vividly of tbe terrible experience she
passed through while In the frozen
nortb The crew emaciated and in
rags looked like so many specters
Captain Papineau’s story of the
whaler’s ill-starred voyage strikes ter-
ror to the heart and causes one to
marvel how men could endure the hor-
rors and suffering of that long period
In the frozen north and still - live
When the Bonaventure was four
months and six days out of port In
the whaling grounds off the west coast
of Greenland she encountered a ter-
rific storm
For a day and a night the torn and
battered whaler opposing her stout
sides to the furious anger of the sea
reeled and tottered under terrific on-
slaughts of wave and wind
Finally they were driven Into an Ice-
bound harbor and In a Bhort time the
entrance and only means of exit wae
effectively sealed with floe Ice
A day passed two days then a
week and still the solid barrier of ice
remained Finally giving up all hope
of escaping by the way they had come
In It was decided to scale the Icy cliffs
surrounding the harbor In an effort to
reach the open sea Placing such pro-
visions as they coilld carry In a small
boat they succeeded In hoisting It to

the cold and desolate waste for two
days they finally beheld the open
sea
An expedition was sent down the
face of the cliff to find a landing place
for the small boat Their quest how-
ever was unavailing '
On a plateau perhaps 200 feet above
the water a sight met their eyes that
all but robbed them of reason Be-
fore them sprawled on an ice hum-
mock stark and gaunt with hopeless
resignation in the staring eyes was a
man — a Viking warrior still clad In all
his accoutrements
When the terrified sailors could
master their fears they approached
and gazed with reverential awe on the
figure that once breathed moved and
had its being In some century long

A short distance away the Bonaven-
ture’s crew came upon the stiffened
forms of others — all disposed in atti-
tudes that bespoke utter hopelessness
and despair

polar cold for thousands of years
The Bonaventure’s crew with the
superstition for death 'common to all
sailormen after their first fright was

marooned seamen underwent heart-
rending Buffering Their search for a
place to launch the small boat proved
unavailing and they sought the whaler
once more for the warmth and pro-
visions It afforded There in the little
harbor with the ice jam still rearing
an Impenetrable barrier between them
and the outer world they awaited the
end with dogged resignation
One morning after eight months’
Imprisonment they awoke to find the
harbor entrance clear Feverishly they
sprung by her rough experiences with
a hawser towed the Bonaventure forth
Into the open sea The voyage home
was slow and fraught with danger for
the whaler’s seams bad been badly
sprung by her rough experience with
wave and Ice Plying the pumps con-
stantly kept her afloat however and
after a long and tedious trip she
finally limped Into her home port

gress Enforcement Attorney Cald-
well will appeal to the United States
supreme court of Love county and
Webb High and others of Wlowa
county decided by the state court
of criminal appeals during the last
week In each Instance the state
court held that the Interstate char-
acter of a liquor shipment obtained
until It reached the home' of the
consignee providing It wag taken
there in the original package by
continuous journey whether final de-
livery wa smade by the common
carrier or by the consignee himself
The basis of the appeals will be
the contention that the Interstate
character of a liquor shipment ter-
minates when the common carrier
has completed Its contract whether
at the depot or the residence of the
consignee which Attorney Caldwell
says Is the bolding of the courts
