8tate Auditor Will Not Assess
Against Corporations This Year
GUTHRIE: Acting upon an opinion
of Attorney General Cbas J West
that the gross revenue tax cannot be
collected against public service cor-
porations until October 1 1909 State
Auditor Trapp will not attempt to col-
lect the tax from such corporations
this year He will however collect
the gross production tax from such
private corporations and individuals
as are subject to Iti beginning at once
as the law plainly states that the tax
upon Buch corporations Is due quar-
terly beginning with the first quarter
after the bill was passed May 2i
1908 producers of oil gas and own-
ers of mines who pay upon gross
production will be required to pay t -e
tax before the 31st of this month or
the tax will be delinquent
The gross revenue bill states that
the gross revenue tax upon public
service corporations Is due annually
the first tax being due Oct 1 1908
The attorney general hold3 however
that If the tax were collected upon
such corporations for a year previous
to that date it would be necessary
to collect a tax for a period preced-
ing the passage of the bill which
would be Impossible He therefore in-
terprets the Intention of the legisla-
ture to be that the tax upon these
classes of corporations Is not due un-
til October 1 1909

SL Louis Company Will Apply for
Right to Pips Gas
GUTHRIE: Reports have reached
here from the oil region that H S
Anderson of St Louis is In Okla-
homa making an Investigation as to
whether gas for fuel can be piped
from this state to St Louis Several
companies have applied to the St
Louis city council for franchises to
carry Oklahoma gas to that city but
before granting any franchise the
city officials are investigating the
feasibility of the scheme
The news of Mr Andersens’ report-
ed Investigation lias stirred up slate
officials who believe that laws ras-
ed by the last legislature providing
that any foreign corporation cannot
take out a domestic charter without
having it stipulated hi the charter
that the company will not pipe gas
out of the state Letters came 'to
Attorney Genercl West fre-tn St
Louis asking whether that city could
be supplied with natural gas from Ok-
lahoma and Mr West replied that it
cold not
It is stated however that since
the state could not compel the Brai-
lle Oil and Gas company to take out
a domestic charter it could not force
a gas company to do so and could
not enforce the Oklahoma gas law
against it
Colonel J C Noble Is a representa-
tive of J O Rodgers and others who
have applied for a franchise to supply
natural gas to the city of St Louts
from the Oklahoma field
‘My company is ready and willing
to put up a bond of 3250000 binding
us to begin a pipe line sixty days
after the granting of the franchise”
he said "Should we fail in this par-
ticular we agree to forfeit the bond
to the city of St Louis
Decapitated by Train at Bartlesville
BARTLESVILLE: Thomas P Mun-
dy foreman of the plumbiag depart-
ment of the National Zinc Smelting
company was found dead here In the
railroad yard3 His head had been
severed from the body by a passing
train He Is survived by three
daughters all residing in this city

his message to the Choctaw legisla-
ture recommends an early settlement
of all tribal matters with s-trict ad-
herence to tribal treaties the sale ot
2090000 acres ot surplus lands in-
cluding the forest coal and asphalt
lands opposes the reopening of tne
citizenship rolls and recommends that
the Indian council pass upciF certain
applications for enrollment and sug-
gests that a commission composed of
three members two cf whom shall
be Indians a Choctaw nnd a Chicka-
saw be apolnted to appraise and of-
fer for sale the coal and asphalt land
' Abe Snyder a farmer living near
Owasso in Tulsa county died from
hydrophobia as the result of being
bitten by a cow afflicted with rabies
Two weeks ago a dog belonging tc
Snyder weit mad and bit the cow
which animal gave no etidence of ra
bles until she attacked Snyder who
was milking her

Seven Coaches Laden With State
Fair Visitors Overturned
OKLAHOMA CITY: In a collision
between an eastbound Rock Island
passenger train and a freight train
at Yukon seven miles west of here
Tnursday seven coaches of the pas-
senger train’ which was loaded with
state fair visitors were derailed but
only one person was seriously injur
ed although a score received minor
bruises
Stella Pyle of El Reno who was
most seriously injured is expected
to recover
The passenger train was standing
at the Yukon station when leaking
air brakes of the freight train on a
siding caused it to crash Into the cen-
ter of the other train
The engine and four coaches were
past the evltch when the two run-
away cars dashed Into the train turn-
ing the remn'ning five cars on their
sides
'A telephone message to El Reno
summoned a relief train and the more
seriously Injured were taken to a
sanitarium In El Reno where moBt
of the Injured lived Witnesses de-
clare the escape of passengers with-
out fatalities was miraculous

ty district court against C W Rambo
the last treasurer cf Oklahoma Ter-
ritory and on three concurrent bends
including as defendants the Columbia
Bank & Trust company of Oklahoma
City and 30 prominent business men
and politicians of Oklahoma City and
Guthrie
Judgment is asked for B145T4o5
said to have been deposited in the
Capitol National Bank which failed
here April 4 1904 with Interest on iae
principal to date bringing the total
to 11905487
Treasurer Rambo It is charged
tailed to Issue checks on the first
troied amount turned over to him
by Secretary William Grimes until
after the Capitol National Bank had
passed into the hands of the comp-
trailer of the currency and lo ef-'
Tort has been made it is stated to
recover the lost deposit Secretary
Grimes filed l)ls report April 1 and
Treasurer Rambo did net present the
checks to the bank while it was sol-
vent a period of only three days

has been named as county game war-
den for Logan county He has ap-
pointed a number cf deputies and has
warned the restaurants and hotels

Interurban Projects are Transferred
OKLAHOMA CITY: The Interur-
ban projects of the Oklahoma City
street railway company were turned
over to Marcus Pollasky of Chicago
and future expansion of the system
will be conducted under his supervi-
sion This also inclines the Guthrie
street car property The Interurban
lines in contemplation are those from
this city to El Reno Norman Guth-
rie and Shawnee
Governor Haskell has issued a
proclamation declaring Marlow a city
of the first class

Copyist’s Error Puts Oklahoma in Fi-
nancial Distress
GUTHRIE: The dlacovery that the
general revenue bill passed by the
last legislature provides for a state
levy only for the fiscal year ending
June 30 1908 caused a sensation It
apparently means that the levy re-
cently made by the state board of
equalization for the entire nineteen
wd a half months from November 16
1907 to June 30-1909 will have to be
set aside and a new lety made cov-
ering only seven and one-half months
The trouble is all caused by a copy-
ists' blunder There is no question
hat the Intention of the legislature
was to provide for a levy for the full
i3cal year ending June 30 1909 and
for the fractional year ending June
10 1903 and the engrossed qopy of
the bill as it passed both houses

and presiding officers of both the I
louses It was made ”1908’' in both ’
places thus cutting out entirely the
levy for the full fiscal year
