the city for a term of twenty years:

improvements, including the laying of
the mains ami the setting of the twenty
five additional fire hydrants an con-
tracted for; and the fixing of the springs
in a sanitary condition and beautifying
the sanio under the supervision of the
city engineer. These improvements to
lie completed within four months from now Stati! of < tklahoma, its successors
the delivery of tln bonds to the 'Tahle-
quah Municipal Water Company;
$12,000 to l>e retained by the City of
Tahlequah, to be delivered to the
Tahlequah Municipal Water Cjinpany
as follows: upon delivery of pipe, a
sufficient amount to pay actual cost of
pipe and freight thereon; and upon
delivery of hydrants and valves and
other material, an amount equal to the
purchase price with freight. 'Ihe bal-
ance of the $12,000 to be paid to the
water company noon the completion of of the < ity
said improvements. The material to be as follows
used in these extensions aud im-
provements shall be the same as was
used in the construction of the water
plant. The Tahlequah Municipal
Water Company further agrees to
transfer the title of the water plant
as above specified for $08,000 of
bonds to draw 4.7"i per cent interest.
The water company will make the
above transfer to the city, on the fol-
lowing terms, viz:
That the City of Tahlequah lease to
the Tahlequah Municipal Water Com
pany the water plane for the term of
twenty (30) years. The water company
to give bond that they will op.'rate aud
aiaintaiu the property as it is now
operated by said company, the rents
not to exceed the rates named in the
lease.
In consideration of said lease the

contracting with the Tahlequah Muni-
cipal Water Company, of Tahlequah,
Oklahoma, a corporation organized
under the laws of the United Htates,
then in force in the Indian Territory,

(30) years from the acceptance in
writing of this ordinance by the presi-
dent and secretary of the Tahlequah
Municipal Water Company, with the
official s ';il stamped thereon.

of Tahlequah, Oklahoma,
Section 1. The City of Tahlequah,
Oklahoma, hereby contracts with and
leases to the Tahlequah Municipal
Water Company, of Tahlequah, Okla-
homa, a corporation organized under
the laws of the United States, then in
force in the Indian Territory, now the
State of Oklahoma, for the delivery of
water in all streets, lanes, alleys and
other public places where pipes are
laid or may l>e hereafter laid in said
city through s-ud pipes, upon the terms
and conditions contained in this ordi-
nance.
Section 2. This contract shall remain
and be in full force for a term of twenty

and acceptance of this ordinance. Dur-
ing the said full term of this ordinance,
the Tahlequah Municipal Water Com
shall maintain and operate the

water works for delivering in nil said
streets, lanes, alleys and other jiublic
places where pipes are laid or may
hereafter ba laid, with water through
said pipes for the extinguishment of
fires in said city, and for domestic pur-
poses, manufacturing and industrial
uses in said city.
Section 8. After this lease has been
accepted by the Tahlequah Municipal
Water Company, then for the full term
of twenty (20) years, the Tahlequah
Municipal Water Company, its suc-
cessors or assigns, shall continue to
operato the water works without de-
fault and shall deliver a constant and .in-
interrupted supply of water in said city
for the various uses herein provided; and
if the delivery of water shall cease or
make default from any cause or neglect
on the part of the water company, its
successors or assigns, for a period of
ten days at any one time, the mayor of
said city shall take possession of the
water works aud all of its appliances
and operate the same aud shall have
the right to charge the expense to the
said water company and they with
their bondsmen shall lie liable for any
inconvenience and expense that the
said city is caused by any neglect on
the part of the said water company.
The said city shall also have a right to
cancel this lease upon the failure on
the part of the said water company to
carry out any of the provisions of this
lease.
Section 1. The Tahlequah Municipal
Water Company shall have the right to
make all excavations in the streets,
lanes, alleys and other public grounds
in said city as mav be necessary for the
maintaining and operating and extend-
ing service to consumers in said city;
such excavations shall be refilled aud
repaired with all possible speed so as to
interfere as little as possible with the
use of the streets, lanes, alleys and
other public grounds, or with the
property of others, and such streets,
lanes, alleys and other public grounds
shall be restoied to as good condition as
they were before, or as near as may be:
and provided further that the Tahle
quali Municipal Water Company and
it< assigns shall hold the said city
harmless from all liability from injury
to all persons, animal* or property re
suiting from such excavations.
Section .V Shall the city council
d jem it necessary for tho convenience
of citii.'ns to extend the mains or make
any other improvements in the water
works, they shall notify the said water
works rwiny, its successors or as-
signs, in wilting, designating the con-
templated improvement: the Tahlequah
Municipal Water Company, its succes-
sors or assigns, upon receiving this no
tice shall arrange so that in making
these improvements, it shall be as little
inconvenience as possible to its patrons
while connections are being made.
Section ti. All improvements and ex
tonsions which are constructed by said
city, the material used in said con-
struction must be of tho best of the
several different kinds for tho purposes
used, such as cast iron pipes for mains,
Coroy fire hydrants or equally as good,
and shall be constructed in a way so as
to incur to the water company as little
expense as possible to maintain.
Section 7. Tho Tahlequah Municipal
Water Company, its successors or as
signs, shall have the right to make ill
needful rules for the protection of said
company for the operating of the water
works, for the tapping of the main*
and for tho proper size of services and
for the shutting off of the water for the
