Said to Have Been Taken
to Missouri on a Spe
cial
A. rumor spread ovor town this mor-
ning thut Alexander Jostor the man
charged at Tocunisoli with a murdor
committed !u Missouri 28 yoara ago
and whose trial under habeas corpus
proceedings was postponed to the 3d
had been taUun away from Tecuinsoh
but how or by whom or where takon
to no one seemed to know. The Lead-
er sent a telephone messugo to
Sliawueo the nearest point to Tecuin-
soh which tho survieo reaches and re-
ceived a reply that Jester was taken
away Friday at ono o'clock but how
or by whom or where to tho message
did not say nor did the sender seem to
know. Tho Leader then sent another
message asking (or all tho pai Hon-
iara and neudlne tho answer to this
called ou Governor Humes but ho had
no information about tho matter and
supposed tho man wasstill in jail at
Tecumseh.
ti Ono report is that an engine from
Oklahoma City was run to TecumBoh
Saturday night and the prisoner trans-
ferred to a special which had beon
provided and paid for by John Oatos
the brother of the murdered man and
with a full head of steam on it carried
tho party in charge of tho prisoner out
of the territory before the ollleers at
Tecumseh knew anything about it. At
any rate the Bpocial passed Outhrio at
about Bevcn o'clock Sunday morning
with tho prisoner on boiird and In
charge of Missouri ollleers Thoro Is
no doubt of this as several pollco of-
ficers of Guthrie wore at tho depot and
they learned tho facts from ofllcers in
chargo of Jester but could i)Ql lauru
tho particulars of now bo wa3 e jtton
away from tho ofllcers ut Tecumseh.
The facta In tho whole matter are:
that tho probate court at Tecumseh
had no lurisdietlon of such cases and
as Sheriff Molson from Missouri bold
Governor llarnes' warrant for the ex-
tradition of the prisoner lie simply
waited until au opportunity presented
itself and then spirited h's man nut of
tho jurisdiction of tho authorities of
l'ottawatomio county while the pris-
oner's counsel were sloeping on tholr
arms awaiting the termination or tho
habeas corpus proceedings before the
probate court If th's court was with-
out jurisdiction as appears to bo tho
case the Missouri ollleers in removing
tho prisoner under the warrant of the
governor cannot be hold for kidnap-
ping and tho oxit of Jostor closes the
case so far as this terntery is con-
cerned. Just us we go to press tho Lender
received tho following message from
Tecumseh: "They took .lebtiy away
Satnrday night on a spocial train."
Later Jester Is now In the jail at
