day afternoon while those of the
councilmcn and school board were
belli to bo Invalid.
It wks agreed by the attorneys on
both sides that tho decision on one
case should hold for all. I). II. Goode
not being present that of Olsmilh
was taken up. Tho convention pro-
ceedings were first considered. Jurif o
Dale ruled that inasmuch the law pro-
Tided that only four political parties
were entitled to regular eati of con
venttons and that tho call for a citi-
zens' convention was irregular and
not properly authorized that tho en-
tire proceedings was illegal. This
ruling sustained tbo oity election
board in their decision in leaving tho
names of all candidates for tho conn-
il and school board off the tiokot.
Then came the arguments jbm to
whether both Olstnitb and Qoodo woro
entitled to their place upon the ticket
by reason of petition. Tho counsel for
the board attempted to show tho il-
legality of these potitlons as tboy con-
tained only twenty names of potlonem.
This was all that were required by
law but thoy contained the name of
William Crane whom the board claim
ed was not a legal votor. The testi-
mony of several witnesses went
'o show that Orano held a re-
jected filing upon a homestead in
the Kickapoo country aud that ho had
not registered in tho city of Guthrie
theteforo could not bo a qualified
voter. In giving his docislon upon this
point Judge Dale decided thero was
1.0 question of Crane's citizenship;
thero was no question as to his eligi-
bility as a voter in Guthrie if Crano
saw fit to exercise it Whether or no
It would jeopardize Crane's claim to
tho land was an alTalr upon which he
was at llborty to act. The fact was
well established that Crane was a
legal votor in tho city of Guthrio if he
saw lit to exorcise tho right iu tho
coming elections. The election board
was then ordorcd to print tho names
of D. II. Goode for mayor and Frank
Olsmlth for police judgo upon the
tiokot.
In his remarks Judge Dale sought to
Jl'isanhoepxtlojv. board that
they were simply a ministerial tri-
bunal and not a judlolary one and he
further cautioned candidates to pet
nioro than twonty signers to a petition
when tboy sought to go in that way.
He further said that whan thero was a
question of fraud it was the plain duty
of election boards to take competent
testimony and establish such facts 1h-
fore thoy acted Tho Judgo deprecia-
ted tho hasty and unauthorized action
of several lato election boards upon
this aamo line that of depriving citi-
zens place upon ballots upon more
hoarsay alone.
