House bill 33 which re-enacts the
law In force before 1898 as to the town
ship auditing board being composed
of the township trustee treasurer and
clerk. The bill was road and favor-
ably recommended by the committee
without discussion.
Uniformity of Marriage
House bill 77 as to uniformity of
mnrriaDSS. was next considered. Tho
eeetton in the bill which legalizes all
blanket Indian marriages wasstrlokon
out as was also the prohibition against
marriages betweon white and In-
dians The prohibition of marriage between
cousins ot the second degree was also
stricken out of the bill
Mr. Gould said the bill seemed to
take a good doal of liberty m stating
who could consummate marriages.
President Johnson substituted the
word "contracting" instead of "eon
eliminating" In several plaoes In tho
bill which woe ndopted.
Mr. H. S. Johnston offered a proviso
that the bill should not interfere with
the settlement ot a suit in bastardy or
support of a mother or of a bastard
child wb'di was afterwards with-
drawn and submitted in a slightly
different form by President Johnson
who moved that it be adopted as a
substttuto for all pending motions ou
this point. Adopted.

The provision in the bill absolutely
forbidding marriages under IB and IS
was nmonded 10 that marriages might
be had it consent ot parents or guar-
dians be obtained by Marion but whb
lost by the adoption of President
Johnson's substitute. The bill was
favorably recommended and the com-
mittee rose.
On motion of Uould council bill UU
requiring express companies to take
out licenses was advanced to a second
reading and referred to the committee
en ways and menus. The bill is an
exact copy of the Dakota law 011 this
fiubtect.
Mr. Uanner moved that the vote bo
reconsidered by which council bill 54
as to issuance of bonds to pay judg
ments against municipalities was
killed; also Marntn mads the same
motion on council bill St as to em-
ployment of relatives by municipal
oflioors whleh motion will 00 mo up
toduy uudor the rules.
A motion by Marum that the Sister
of Mercy bill (U. 11. No. 183) whleh
had been read for the first time in tho
oouneil be advuncsd to a second read-
ing was lost
The rules were suspended ou motion
of Marum and house bill 135 was ad-
vanced to a second reading and rend
and referred to the committee on
education. This bill Is also a ssparate
school bill and the purpose of advana-
iog it was to see if it could bs harmon-
ised with the separate school bill
previously passed by the council.
On motion ot Deltols house bill 84

advanowl to a second reading und re-
ferred to eotniulttee on muuieipal
corporations.
Council bill 60 was placed on its
final passage. This bill provides that
in trials by referee or by the uourt
without a jury appeals may be taken
without a formality of filing a motion
for a new trial. The bill passed with
none voting against
