married O'Neil was 24 years old and

The train was in charge of Conduc-
tor M C Shipley of Monett and con-
sisted of the cars that left the track
two day coaches and two sleepers
The wreck occurred at a dangerous
point exactly where a disastrous
freight wreck occurred two years ago
Warren was running at about thirty
miles an hour rounding a sharp curve
and the engine left the rails at a
switch leading into a "Y"
The engine plunged into the ground
between the tracks of the “Y” and
turned over half burying itself in the
ground The force was so great that
the tender was lifted entirely over
the boiler and landed bottom upward
with the forward end turned toward
the engine pilot In its flight the
tender stripped the cab from the en-
gine The baggage and expres car
following skidded to the left and
stopped with the rear end on the
track The mail and smoking car fol-
lowed it shot away to the right plung-
ed down an embankment and stopped
with the rear end on the track the
two cars forming an acute angle with
engine lying squarely between
O'Neill was caught beneath the fire-
box and pinioned His death was due
to burns and scalds from steam Two
hours elapsed before he was extri-
cated While being burned to death
by the hot cinders in which he was
lying and the escaping steam he di-
rected the workers how to release him
He died en route to a hospital in an
ambulance
Warren as the engine careened
was hurled out of the cab through
the air a distance of fifty feet strik-
ing the ground beside the baggage

the body and he was also badly
burned and scalded He nearly bled
to death before surgeons could stop
the flow of blood
On the train were two mail clerks
and a baegage man None was hurt
The smoking car was unoccupied
Investigation showed that the wreck

formation received here Is to the ef-
fect that the Kiowa-Comanqhe county
Indian pasture lands of one-half mil-
lion acres in Comanche county will
be sold at public auction instead of
by sealed bid plans A letter from
the acting secretary of the Interior
Judge Ryan received at the United
States land office in Lawton indi-
cates that President Roosevelt will is-
sue his proclamation much in advance
of the time expected by all and that
the commutation act under the home-
stead laws will be in full force and
allow a prospective purchaser the right
to prove up on the land after four-
teen months’ settlement by paying
the deferred payments The plans of
auctioneering the land will be set out
in President Roosevelt's proclama-

LAWTON: The interior department
has sent Engineer George L War-
ner of the United States geological
survey to Lawton to manage the ex-
penditure of the $60000 appropriated
by the last congress for the exten-
sion of the Laft'ton waterworks sys-
tem Engineer Warner will open an
office here and begin surveys through
the Fort Sill military reservation to
the large springs at the head of Medi-
cine creek near Mount Scott as soon
as a permit for making the surveys
and laying the mains can be secured
from the war department From this
source an abundant supply of the pur-
est mountain water can be brought to
the city by gravitation The reservoir
contemplated will be 200 feet above
the highest point in the city

Two Men Arretted for the Crime Have
Been Positively Identified by the
Woman Who Was Found In Semi-
Conscious Condition
EL RENO: Samuel Roland and
Miss Corlmio Jones were held up and
robbed by two tramps while out
walking on the raldrond After the
vlllluns had stripped their victims of
everything they carried the woman
to a secluded spot and criminally as-
saulted her The man made his escape
came to town and reortod to the of-
ficers who started immediately for the
scene of the crime
As the officers were paslng a box
car In the railroad yards a man jump-
ed out and started to run Thinking
he was one of the parties the officers
commanded hint to halt and on Ills
falling to do so they shot mortally
wounding him
Later the two men who are thought
to have committed the crime were
captured about a mile west of the
city and were landed In jail The man
who was killed and all others con-
nected with the affair are strangers
here
The woman positively Identified the
prisoners after recovering conscious-
ness She was badly bruised and re-
lates a thrilling story

when Burke was sent to bring him in
He was taken to the jail here to await
his preliminary trial
According to Brown’s story he kill-
ed Hillegar In self-defence He
states that he drove up to the house
of Sherman Gooche where Hillegar
was staying and the two got Into a
dispute when Hillegar pulled his gun
he fired in self-defense kiliink Hille-
gar The dispute is said to have
grown out of an alleged debt to Brown
who had formerly worked for Hille-
gar It is said that Brown had been
in court before for stealing cattle but
was not convicted

QUARANTINE PROCLAMATION
Issued at the Request of the Swine
Breeders of the Territory
GUTHRIE In accordance with the
requests of swine breeders of the terri-
tory tbe live stock sanitary commis-
sion has issued a new quarantine pro-
clamation amending rule 6 of the pro-
clamation issued last May so as to
read:
"That no swine shall be shipped
from any point outside of the territory
to any point within tbe territory of
Oklahoma for feeding or stock pur-
poses unless they shall have a certifi-
cate and bill of health Issued by an
agent of the bureau of animal Indus-
try” The old rule applied only to swine
shipped from public stockyards
As a result of the clean-up recently
made by tbe cattle inspectors in the
western half of Payne county a new
quarantine law was established
through that county on the range line
between ranges 2 and 3 east

credit the report that a portion of the
lands will be sold at El Reno Filings
however will be made at the land

MUSKOGEE: The commission to
form fifty-five districts for constitu-
tional purposes out of the Indian Ter-
ritory met here and adjourned without
accomplishing anything owing to the
fact that Judge Clayton has not got-
ten the census returns in from the
townships in the Choctaw and Chick-
asaw nations
The commissioners announce the
approximate population of the various
nations as follows:
Cherokee 240000
Creek and Seminole 185000
Choctaw and Chickasaw 400000
Judge Gill states that the commit-
teeman appointed to make the Cbero
Uee census report 240000 and the
postmaster's reports show 195000 Ow-
ing to tfie large showing made in the
Choctaw and Chickasaw nations he
says he will be forced to accept the
240000 reports
Judge Gill thinks an election proc-
lamation will be issued not later than
September 1 There must be sixty
days’ notice of elections
One policy has been determined by
the committee They will not split
townships A11 shapes in districts
may result but townships will remain
Intact
As soon as the districts are made
maps will be printed showing the
townships in each district and those
will be distributed broadcast over the
territory

CHANDLER: The little city ol
Sparks In Lincoln county has just
passed an ordinance prohibiting boys
under the ago of eighteen frequenting
the pool halls or smoking cigarettes
or pipe on the streets of the town
The effect of the ordinance while
yet lacking a decision from the at-
torney general as to Its constitution-
ality will be welcomed by the citi-
zens of the little town It could be
applied to many of the larger towns
of Oklahoma with considerable
benefit
