District Court Proceeding.
FIRST DAY.
The April term o£ the district court of
Lincoln county opened Monday with Hon.
John H. Burford presiding.
The first business was the empaneling of
the Grand jury. The following gentlemen
were examined, accepted and sworn and
instructed by the court". A. C. Hester, W.
C. Graham, Eli Mill, G. L. Summers, Jack
Castator, Frank Baker, G. W. Goodnight,
W. L. Little, I. C. Pierce, Fred Dunbar,
J. H. Bryant, G. W. Arrwood, G. Harri-
son, John Rader, J. M. Hoffman, H. M.
Phillips.
I. C. Pierce was appointed foreman by
the court and Leo Zipf was appointed U. S.
bailiff to be in charge of the grand jury.
The following-named persons were ad-
mitted to citizenship and took the oath of
allegiance to the United States: William
Ebers, Lizzie Leisterer, Katherine Haener-
gardt, Henry Schreibker and John J.
Eiward.
Capt. A. A. Beasier and*H. M. Wood-
man were appointed court baliffs.
C. B. Wilson, E. Foster and John Embry
were appointed as term committee to exam-
ine and report upon applicants for admis-
sion to the bar.
On call of territorial docket the following
orders were made:
Territory vs. Fletcher D?fore, continued
for arrest.
Territory vs. John Keokuk, continued^for
arrost.
Territory vs. Adam Parker, continued for
term.
Territory vs. J. H. Pryor, dismissed.
Territory vs.. Cal Sherman, et al, dijmiss-i
ed as to Cal Sherman and bond discharged
because of death of Sherman.
Territory vs.C. L. Hages, continued for
arrest.
Territory vs C. W. Little, dismissed.
Territory vs. Wm. Lee, dismissed at
cost of prosecuting witness.
Territory vs. Earl Stewart, dismissed at
cost of defendant.
SECOND DAY. *
James Norton and Mrs. Rosa Marti were
admitted to citizenship and look the oath of
alleniance.
On call of civil docket following action
was taken in cases named:
Jennie Griffin heir at law Chas. Seay vs.
John W. Morgan, dismissed at cost of
defendant.
J. E. Davis vs. M. M. Egbert, dissmised
at cost of plaintiff for failure to comply with
order of court and allowance made to referee
services as prayed for in report.
Sarah J. Frazier vs. Mary J. Silver, dis-
missed at plaintiff's cost.
Thos. A. Taylor vs. Town of Chandler,
demurrer to amended petition sustained and
leave to file amended petition in 30 days.
Defendant to plead in 10 days thereafter.
Anna Clark vs. David C. Clark, decree
of divorce at plaintiff's cost.
Lillie C. Calvin vs. Wm. I. Calvin, d«-
cree granted at cost of plaintiff and ^ plain-
tiff restored to her maiden name, Lillie C.
Riner.
Cicero Sims vs. H. C. Glover, demurrer
to petition overruled.
Bell Dolphin vs. John Dolphin, divorce
granted at plaintiff's cost.
H. S. Emmerson vs. W. S. Forest, O. L.
Dowell and Jas. W. Hockaday, dismissed by
plaintiff at his costs.
H. S. Emmerson vs. 0. L. Dowell and
Jas. W. Hockaday, dismissed by plaintiff at
his cost.
A. H. Gleasce'n vs. Mary A. Noble, dis-
missed by plaintiff at his cost.
W. H. Bateman vs. Jos. A. and Sarah
J. Fry, demurrer to answer overruled and
five days given to file reply.
Jacob Brown vs. Patrick Murphy, leave
granted to file amended petition. Defend-
ant to plead in five days thereafter. e
Elijah Stevens vs. Patrick Murphy, same
action as in fast case.
Robert E. L. Mathis vs. E. M. Mathis,
dismissed at plaintiff's cost.
P. S. Hoffman vs. Jesse Sherman, et al,
heir at law of Calvin Sherman continued
for service. . '
Long-Bell Lumber Co. vs. S-w Cotton
Seed Oil Mill, leave granted plaintiff to
withdraw motion to amended answer and
to reply within 10 days and case continued
for term.
W.A.R. White vs. St. Louis & Oklahoma
City Railroad Co., et a!, continued for, term
by agreement.
Zema Zahl vs. Wm. Zahl, plaintiff
granted divorce and custody of child.
Sewell Jones vs. Harriet Jones, divorce
granted at plaintiff's cost.
Cora J. Mackey vs. Chas. S. Parker con-
tinued for term. ..

petition overruled and 20 days given to
answer.

Moody for assault 'with intent to kill, and
bond fixed at $600.
Indictment returned against* Wm. Jordan
and Chas. Dillon for grand larceny. Bond
$600 each. .
Indictment returned against Chas. Tracy
and Tim Cashman for robbery and bond
fixed.at $600 each.

divorce granted at cost of plaintiff-

Carter, sheriff. Motion to amerce the sheriff
in amount of judgment secured by Shafer

because execution issued out of: district
court had not been returned within the
statutory time was overruled because no
properly certified copy of the judgment ren-
dered in probate court against Pripgey has
been filed in the district court.
Emil Barwig vs. Sarah J. Frazier—mo-
tion to confirm sale of real estate sustained
and deed ordered executed, th£ clerk to re-
tain surplus payable to S. J. Frazier until
further orders of this court.
H. C. Reaves vs. J. H. Carter, sheriff,
motion sustained and case dimissed at
plaintiff's cost.
Emma Walker vs. Jacob D. Walker,
divorce and custody of child awarded plain-
tiff also a note of $150 signed by George
Hazen and in possession of defendant which
he is ordered to deliver to clerk o£ court for
plaintiff.
Joseph H. Bayes vs. Wm. Bradley, find-
ing for plaintiff in sum of $63, attachment
sustained and attached property ordered

! country last Tuesday. .
The advance agent of Colorado Grartt's

The required amount to secure the per-
1 manent railroad survey was. quickly raised
I and sent in.
There was a birthday dinner given at
Sydney Murphy's residence on the 15th, it
being his birthday. .
.There was a pie social given at the
school house Srturday night for the purpose
of raising money to buy song bouk?. Ihe
amount raised was $1§.
We are glad to see our friend Rutus
Lenington who has been serving two years
in the Philippines back with us again. He
looks well and hearty and says he feels
well. •
The grandson of Mr. Corbin was hauling
wood recently when the team became un-
managable and .the young man fell off the
wagon on a sharp ax, cutting a large gash
in his thigh.
On last Saturday D. G. and Lyda Robert-
son buried their little son, Leonard, age
three months and 15 days. This is the
second child they have lost in five weeks.
They have the sympathy of the entire com-
munity.
W. H. Bennett, representing the Western
Poultry and Game Co., of St. Louis, was
here Tuesday and Wednesday giving our
farmers some pointers in -regard fo the
planting and cultivation of cantaloupes for
1 the St. Louis market. He expressed con-
! fidence that this crop would be a success
here, and, in a conversation with The
News, he said there was no question but
i that his company could handle all, and
j more, than could be produced here. When
I the shipping season comes they will send a
j man here to see to the picking and packing
of the melons, as they expect to ship in car-
| load lots. Mr. Bennett has had many years
i experience in the development of this busi-
1 ness and is an interesting talker. We be-
lieve that his visit will be productive of
much good.
