INSURANCE LAW
By the filing of a suit before
Judge Oldfield of the Oklahoma
County District Court and the
granting of an injunction by that
vorthy pruliibiting any further
activity by the State Insurance
Commission until the hearing be-
fore his court on August 4th the
ground has been laid for what
will probably be a complete test
by the Supreme Court of the con-
stitutionality of every feature of
the insurance law The influen-
ces behind tlie attack on the law
aje generally considered to be the
present Insurance Commissioner
the old Insurance Rating Bureau
and the agents of some foreign
insurance companies that are held
to a more rigid accounting under
the new' law' The State Insur-
ance Commissioner has express-
ed on more than one occasion his
bitter personal enmity toward the
present law and the other agen-
cies that have been placed under
restraint by the provisions of
' House Bill No 70 nave naturally
been ready to join in any attack
upon the law The friends of
that measure however have lit-
tle fear of the final outcome The
iaw was demanded by the busi
ness interests of practically every
city in the state and some such
provisions for vigorous regula-
tion of insurance rates and the
method of doing business in Ok-
lahoma is necessary and will pre-
Y?il even if some of the features
ef the present law were even-
tually held by the courts to need
readjustment or revision The
time has gone by in Oklahoma
when a few special interests
even though aided and encourag-
ed by the treasonable and disloy-
al efforts of quondam state offi-
cers can hope to defeat the just
and equitable demands- of the
people
Future legislatures may like-
wise find it necessary to limit the
arrogant ' assumption of certain
district judges in Oklahoma who
appear to welcome an opportuni-
ty to issue injunctions and set a-
side the functions of any depart-
ment of the state government on
the mere petition to do so by
some interest that feels agrived
over the enforcement of the law
It takes time supreme effort and
eternal vigilence to secure and
maintain the rights of the people
even in Oklahoma but the pre-
sent administration is vigorous-
ly on the job and these interest-
ed assults upon the law will be
jnet with vigor and force to an
early and definite conclusion
NEGRO VOTE PROB-
LEM IN EVIDENCE
The first fruit of the grand-
father clause decision of the su-
preme court of the United States
are observed in school lections
in Muskogee and Okmulgee coun-
ties In one district in Musko-
gee county the negroes packed
a school meeting and elected one
of their number a member of the
board of trustees notwithstand-
ing the district is white County
Superintendent Collette iholds
that a negro is not eligible to
membership in the board of trus-
tees in a white school district
and that another electin will have
to be held or a trustee appointed
In Okmulgee county an election
was recently held and the consoli-
dation of three school districts
voted by a vote of 121 to 43 but
the county superintendent has
been enjoined from carrying out
the consolidation plan one of the
grounds being the allegation that
the election was carried by rea-
son of the fact that the negroes
were not allowed to vote
These incidents of compara-
tively small importance in them-
selves are suggestive of what
may be expected to follow in the
eastern and southern parts of the
state unless some action is taken
to meet the situation created by
the overthrow of the grandfather
clause of the state constitution
The negro vote is already a prob-
lem in Oklahoma ’
CAN’T AFFORD IT
The other day a merchant saic
he couldn’t afford to advertise in
his 'iome newspaper If the man’s
views were not distorted he
would see that he couldn’t af-
ford not to advertise Refusing
to advertise is his most expen-
sive extravagance That same
merchant will spend hours tell-
ing of the “unfair’ competition
of the mail-order houses who are
his most aggressive and danger-
ous competitors yet the meth
ods employed by the mail order
houses which succeed are tjie
very ones which the merchant
refuses to use The mail order
'nouse is first of all an ADVER-
TISER Advertising is the life of
Its business Every magazine'fhat
enters the small town anti rural
home carries the ad of the mail
order house Expensive cata-
logues are printed showing the
illustrations of the actual arti-
cles Occasionally sheets are
scattered broadcast over the
country as a special “come-on
for the bargain hunter Instead
of doing these tilings in a smal-
ler way by the means of the use
of the columns of his local pap-
er the merchant who can’t afford
to advertise sits down and “cus-
ses” his tough luck and won-
ders why he can’t get the busi-
ness He never thinks he has a
better opportunity to reach the
people in his own neighborhood
than the mail order house has
It doesn’t cost him as much as
it does the outsider he can draw
the people to his store and show
them the actual article he is ad-
vertising and when they buy
they can take their purchase
home with them instead of hav-
ing to wait several days for it
Advertising is an investment It
should be charged to your sell-
ing cost Figure what percent-
age you have to pay to advertise
campaign on the computati'oni

FOLK LORE CLUB FORMED
Formation of a folk lore club
for study of the Oklahoma folk
lore was accomplished at a meet-
ing held at the University of Ok-
lahoma The meeting was at-
tended by a number of Oklahoma
students and persons of literary
inclination and the organization
of the Folk Lore Club followed
as a natural consequence
"The Importance of Folk Lore
on a Race’s History” was thte
subject of a paper read by L N
Morgan member of the English
faculty of the University of Ok-
lahoma Mr Morgan traced the
effects of the folk lore of the
early inhabitants of the British
lies on the literature of the fam-
ous English writers He also
spoke of the New England
writers and their works that have
been handed down to us “Many
children find that the early his-
tory of the colonies is rather dif-
ficult to remember if studied from
a history but when they read the
stories of the Pilgrims and other
early New England settlers they
remember ‘the historical dates
mentioned in the stories and the
piominent characters of that time
with ease”
“How the Cowboy Came to be
Here” was the general subject of
a paper prepared and given by E
E Dale member of the universi-
ty history faculty and The former
Oklahoma cowboy Mr Dale
had been a resident of Oklahoma
for many years before he became
a member of the university fa-
culty and has an almost unlimit-
ed supply of tales poetry songs
and stories of the life and cus-
toms of the race of men that lived
and ruled in this State before the
opening of the country by the
Federal Government for farming
settlement

APPOINTMENTS VALID
An opinion from the office of
the Attorney General at request
of Governor Williams holds that
the appointments -of County
Superintendents of Public Health
made by the present State Health
Officer in pursuance of a law en-
acted by the Fifth Legislature
are valid and take the place of
the appointments made by Dr
Mahrjust before he retired from
the office of State Superintendent
of Health Dr Mahr had made
about fifty such appointments
The occasion for asking this
opinion of the Attorney General
was in the case of Dr William A
Tulleson appointed Superinten-
dent of Health in McIntosh
County in the place of Dr A J
Snelson the appointee of Dr
Mahr

All roads lead to Paden the
mecca of Oklahoma at this time
More attention is being paid to
the test of the Prairie Oil and
Gas company in section 8-12-7
than to any other well drilled in
the Mid-Continent field in a long
period It will be remembered
that last November the Prairie
had a fairly good showing in i
sand found at 2792 feet but due
to the over-production at Cush-
ing it was capped for the time
being
On Friday of the past week
the Prairie started the drilling
deeper of this important test
which is approximately 30 miles
to the south of the Cushing pool
and since then it has attracted
widespread attention and scouts
operators and leasers have visit
ed the scene of the well from all
parts of the state On Friday
the well was drilled one arid one-
half feet deeper and there was an
increase noticeable in the gas
pressure as well as the amount of
oil that was being flowed into
the tank ‘ During twelve hours
on Friday evening the well placed
100 barrels in tankage the best it
has made so far and it is look-
ing more encouraging than it has
since it has been started deeper
On Saturday reports were lack-
ing as the drilling deeper had
been a hard job the formations
not being very soft Within the
next twenty-four hours the cali-
bre of the well should be known
as no drilling was done during
the evening
Many reports have been float-
ed to the effect that the w'ell was
making considerable water but
according to the best information
obtainable the water is coming
from above It was reported to
be through five feet of sand and
worthless hut reports were
fruitless and later details will be
watched with great interest

HOLDENVILLE WELL
What of Holdenville? This is
a question that is being asked
since it has been announced that
the Paden well was to be com-
pleted The well near Holden-
ville in Hughes county belongs
to the Penn-West Oil company
and is in section 4-7-8 At 3043
there was a fairly good showing
of gas and some oil was sprayed
about the rig Later cavings
stopped the gas pressure to a
great extent there being 80 feet
of open hole and the well has
been shut in the last two weeks
Some tools are now en route to
the important wildcat and it will
be drilled in shortly Leasing is
brisk in that portion of the
country and some good prices are
being paid for acreage miles in
advance of the well which is of
unknown quality It is reported
that the McMan Oil company has
made a location in the northwest
of section 13-7-9
