as it occufTcy i n the last issue of
the “Gazetteefrfv published by
R L Polk & Co of Oklahoma
City asking for corrections In
reality it is a report sent in by
one of those famous Botsford
townsite boomers and for the
benefit of those who were not
there we publish it as corrected
It start out like this:

I notice articles printed in the
various newspapers in the Man-Gum-Lawton
land district that
after statehood persons making
final proof will be compelled to
go to the land office to make
proof There is not a word of
truth in such articles The
homestead law allows all settlers
livings distance from the land
office to submit their proofs be-
fore Probate Judges Clerks of
District and Circuit Courts and
also U S Commissioners and
the statehood law does not affect
in any way the rights of settlers
to make proof before' the said
officers the same as heretofore
All-U S Commissioners now in
office will remain until removed
or superseded after statehood
The Act of March 2 1895 crea-
ted the office of U S Court Com-
missioner in Territories with no
other authority than to execute
land office papers There are
but few Court Commissioners
and when statehood is complete
these offices are vacated but
settlers may continue as usual to
make proof before ‘Probate

The Rock Island run an excur-
sion to Ft Worth Saturday night -returning
Monday morning and
from all accounts it was one of
the best conducted excursions of
the season There were very
few noisy people present and
those who Went report a most
enjoyable time About fifty tick-
ets were sold at this place and
among those who attended were:

Will Apply on Land to be
Opened Here
The following is clipped from
arecent issue of the Lawton Con-
stitution: Major H D McKnight of the
Lawton land office has been using
his influence with the General
Land Office in the matter of al-
lowing the homesteader on the
land soon to be opened to settle-
ment the right to commute after
fourteen months settlement
Several days ago The Constitu-
tion published a statement from
the register in which he ex-
pressed his views that the land
would be subject to the commu-
tation provisions He has re-
ceived a letter from Thomas
Ryan acting secretary of the
land office in which is enclosed a
copy of a letter sent to the Com-
missioner of the General Land
Office by the acting secretary
In ths letter it is stated that the
commutation provision will apply
to these lands: It is also urged
that the regulations should be
prepared at the earliest time pos-
sible -
The letter follows:

Replying to your letter of the
Gthinst making inquiry as to
whether or notcommutation proof
will be accepted on pasture lands
to be opened under the provis-
ions of the act of June 5 1906
(Public No 197) I enclose here-
with for your information copy
of a letter this day addressed to
the commissioner of the General
land office bearing upon said
subject

eneral Land Office
Sir: — The Department is in re-
ceipt of your office letter of the
17th instant reporting upon the
letter dated the Cth instant from
the register of the United States
land office at Lawton Oklahoma
in which he makes inquiry as to
whether or not commutation
proof will be accepted on the
pasture lands to be opened for
sale under the provisions of the
act of June 5 1906 (Public No
197) in which you express the
opinion that as the lands are to
to be disposed of under the gen-
eral homestead laws with the
condition that the purchaser
must pay the price agreed upon
and as you found nothing in the

By the second section of said
act it is provided that these lands
“shall be opened to settlement
by proclamation of the President
of the United States within six
jnoiiths from the passage of this '
act-1 and be disposed of upon
sealed bids or at public auction
at the discretion of the Secre-
tary of the Interior to the high-
est bidder under the provisions
of the homestead laws of the
United States and under the
rules and regulations adopted by
the Secretary of the Interior
and such purchaser must be duly
qualified to make entry under
the general homestead laws
” ' The Department is at
present inclined to the view that
the purchaser who makes entry
of any of these lands under the
homestead law should be for the
reasons set forth in the letter
from the register at the local
land office at' Lawton Oklahoma
permitted either to offer proof at
the end of the commutation
period and make full payment
for the land or the usual privi-
lege of completing title after five
years’ residence in which event
the annual installments are to be
paid as provided for in the third
section of said act but these are
matters to be disposed of in the
rules and regulations to be issued
by this Department as provided
for in Section 2 above quoted -and
as the lands are to be opened
to settlement within six months
from the passage of said act
said regulations should be pre-
pared and submitted for depart-
mental approval at your earliest
convenience

sas spent Saturday and Sunday
renewing acquaintances in this
city Mr Kerr was an early
settler in this town but moved
back to his former home in Kan-
sas about two years ago He
