Parker Samuels, Fidelia Savage,
Emma Killebrew. Louisa Quoins,
Lydia Price and William Samuels,
heirs at law of James Samuels, de-
ceased, will take notice that said M
It. Carlisle, plain tiff, did on the 3rd
day of December, 1896, file his peti-
tion, and on January 9th. 1897, an
amendment thereto, in said District
Court within ard for the County of
Oklahoma, in the Territory of Okla-
homa, against the said defendants,
and tliat. said defendants must an-
f,w said petition filed as aforesaid
. .n r before the 13th day of March,
A. D. 1897, or said petition will be
taken as true, and a judgment ren-
dered in said action against said de-
fendants and the estate of said James
Samuels, deceased, for the sum of
One Hundred Dollars, with interest
thereon at the rate of Twelve per
cent, per annum from the Eleventh
day of November A D, 1895, and the
further sum of Fiftv Dollars as at-
torneys'fees for collect,!* g the not.
by suit, for which -aio One Hundr. i
Dollars was given; and a further
judgment against said defendants
and said estate to reform and cor
rect a certain mortgage executed
November 11th, 1895, bv said James
Samuels to said plaintiff, M R Car-
lisle, on the West half of the South-
West Quarter of Section Three in
Town hip thirteen North, of Range
One West, in Oklahoma county,
Territory of Oklahoma, and to re-
form and correct said mortgage so
as to make the same read, “on the
West half of the Southeast quarter
of Section Three in Township Thir-
teen, North, of Range One West of
Indian Meridian in Oklahoma countv
Territory of Oklahoma,” on which
the same was intended to be given
and executed; and a further judg-
ment against said defendants and
said estate for the foreclosure of
said mortgage so reformed and cor-
rected as aforesaid, and adjudging
that said plaintiff have a first lien
upon said last described tract of
land to the amount for which judg-
ment will be taken as aforesaid, and
ordering that said last described
premises be sold with appraisement,
and the proceeds applied to the pay
ment of the amount due Dlaintiff as
aforesaid, and costs of suit, and for-
ever barring and foreclosing all of
said defendants from all rights, title,
interest, property and equity of re-
demption in or to said premises or
any part thereof.
